Wescott \ Mgt Ltd alleged debt

Hi hopefully someone will be able to help with this one.

I recieved a letter from Wescott earlier this week saying that I owed Mgt Ltd £155.

And they had sent the letter to me as they had obtained the address from Experian as a possible forwarding address.

Intrigued I rang Wescott as I have no idea who Mgt are. The man on the phone asked me to confirm current address and when asked told me that MGT provide adult entertainment via Sky or Freeview and the debt dating from Oct 06 but was at a possible previous address of mine hence their tracking me through Experian bearing in mind this is the first I have heard of this company or debt and I moved in April 07 with my mail redirected for 6 months.

I have never had any subscription for anything throught MGT let alone adult movies, the address on the account is an old one of mine although its a pub I used to own and the only Sky on the premises was in the public bar areas on a commercial contract.

What I would like is a copy of the agreement that produced this debt how would I go about obtaining this and who should I ask MGT or Wescott.

    Wescot are obliged to provide you with definite proof is you ask for it that this is a genuine debt you owe.

    You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

    We would point out that we have no knowledge of any such debt being owed to The Loan Company.

    We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.

    We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

    The same thing is happening to me from Wescot. They say they are collecting a debt from Barclays. Now I've long since had a Barclays account, but this debt relates to a an unpaid overdraft on this account.

    The thing is, I never got letters from Barclays, and the Barclays account reference number they gave me does not relate to any account I had.

    I dont want to pay the £141 unless i know it relates to an account I had with Barclays. What should I do?

  • Hi, just noticed the Westcot thing and thought I'd let you know that my husband got a letter from them before Xmas about a debt with Goldfish from yonks ago. We were convinced we'd paid the card and closed the account but sent the standard, 'I don't know what you're talking about, prove it' UNSIGNED letter by recorded delivery and got a very nice letter back saying, 'sorry, you're absolutely right, we won't contact you again' and so far they haven't. So send the letter and good luck!

    Thought I would send an update, I sent Wescot a "prove it letter" which they have replied to stating that they will only contact me again if they need any further information.

    This week I have recieved two letters from them one asking for addresses and dates of where I have lived for the last 3 years (should I reply?) and unbeleivably another letter different reference numbers but this time claiming £14.99 owed to MGT Ltd

    Why should you? It is up to them to prove that you owe anything (proper contract/agreement or proof you made one etc).

    it is for them to prove you owe the debt, not the other way round.
