Bay Trading returns- Faulty goods refused!

I'm after some advice, someone who is up on the SOGA
A while back I bought some shorts (£17) from Bay Trading & when I wore them on a night out the button popped off (not from being too tight as I had actually gone up a size for a looser fit)
I took them back with the receipt still within the 30 days for a refund. I was refused as I had washed the shorts (which I thought was a nice thing to do, seeing as I had worn them all night & I wouldn't wna touch someones sweaty-bum shorts if I was a sales assistant!) They said they cannot refund washed items, faulty or not & I would have to exchange, theres not much in the shop & I spent ages rooting through & finally found the same shorts so swapped.
Now I have a top, worn once, I washed as per instructions but it has seriously shrunk, I wont want to swap for another one as it will definately do the same, so where do I stand? (I think still within 30days)
Thanks!

But what about with the top I now want a refund on? That is a fault in the material that does not allow it to be washed as stated on instructions, it actually says 40* & I did 30*I'm getting older, and lifes getting harder!:mad:0

I have no idea what happened to my reply!
Anyway, you seem to be covered by the SOGA:
http://www.berr.gov.uk/whatwedo/consumers/fact-sheets/page38311.htmlQ9. Must I accept a credit note instead of a refund?
It depends on why you want to return the goods.• If you have changed your mind, then the shop doesn't have to do anything.
• But if the goods are faulty, incorrectly described or not fit for purpose, then you are entitled to your money back (provided you act quickly), and you certainly don't have to take a credit note
• If you do accept a credit note in these circumstances, watch out, as there may be restrictions on their use.
• If the shop displays a sign stating they only give credit notes instead of refunds, they might be breaking the law and you could report them to Consumer Direct on 08454 04 05 06. Consumers in Northern Ireland should contact Consumer Line on 0845 600 6262.
I am not sure about the rules regarding the washing of items before returning though, I have just done a quick google search and discovered people being refused refunds on the grounds that they didn't wash the item before return, as well as the opposite

Washing the goods is irrelevant. You should be able to wash them if that's what the label says. Quite clearly the SA didn't know what s/he was talking about.0
