    The Court of Appeal has decided that, under the Working Time Regulations 1998, a worker on long-term sick leave may not continue to accrue statutory holiday for all the time s/he is off sick.
    Looks like that may be changing, although how it will work in practice in another matter entirely. :rolleyes:

    It seems that

    == a worker who is on sick leave for the whole of an annual leave year is entitled to four weeks' paid annual leave even though they aren't at work. The national courts can decide whether the paid leave can be taken during that year, or whether it should be carried over to another year, but in either case the worker is entitled to be paid.

    == the right to paid annual leave is not lost at the end of a leave year if the worker was on sick leave for the whole of that year or was on sick leave for part of the year and still on sick leave when employment was terminated.
