Severance Pay on Incapacity Benefit help pls

Hi,

I've just come back from a kinda meeting with my employer & Human Resources guy and really need some advice if poss pls.

I've been off work for 3 yrs next month after a knee operation, had another operation since then to repair damage done by the previous op. Anyway been on Long Term incapacity for a few yrs now too. I also get CTC for youngest son.

They have given me 2 options and really not sure where to go.

1. Go back to GP and beg him to let me return to work, the Medical Sevices ppl signed me off until Sept at the earliest.

2. I take Dismissal under medical grounds to which I will get a little bit severance (£1500).

But I aint sure if this affects my Incapacity Benefit? Also if I take the severance, do I stay on Incapacity Benefit as I wont be employed anymore? Not sure if you can only get IB if ur employed.

    I presume they are no longer paying you?

    Incapacity is paid to people who don't have work.

    Have you applied for DLA if your mobility/care needs warrant it?

    My work aint been paying me no. I'm on Long Term IB until they say I'm old enough to get a knee replacement. I did apply for DLA but they said as I dont have a date or anything yet for operation they cannot grant DLA.

    I'd prefer to go back to work but the Medical Services ppl wont allow it so just not sure how this is going to affect everything.

    My work is gonna push for dismissal on Medical grounds with severance pay, but I dont want to mess up my Incapacity benefit either.

    If you are worried that your IB will be stopped if you get severance pay, IB isn't means-tested as such. If a person has a pension from a job, they do take that into account, but only if it's more than £85 per week (anything over the £85 is deducted from your IB pound for pound).

    In other words, severance pay wouldn't affect it. HTH.
