Hi.
I own my own house through inheritance and it is in my name only. I have a boyfriend who has £13,000 unsecured debt. If we marry can they take my house away from me even though it is in my name only, also if my partner went Bankrupt after we are married can they take my house??
Many thanks.

Sorry whos 'they'??You may walk and you may run
You leave your footprints all around the sun
And every time the storm and the soul wars come
You just keep on walking0 -
from reading this I would imagine 'They' would be her boyfriends creditors, sorry I don't know the answer to that someone may be along shortly to help though..This signature was previously violated by my wife, that'll learn me to stay perma logged in.
Fortunately, the offending comments have now been removed - my apologies to all who had to read it and laugh at my expense.0 -
If the debt is in your boyfriend's name then you are not liable for it and this is included if you're married, aslong as you do not put your partner's name down on the mortgage then they can not apply through the courts to put a charge on your house.
Why does your boyfriend not sort out his debts, he should go to his local cab and get debt advice and they will help negotiate with his creditors. I personally would wait until he has cleared his debts before you get married. Make sure he does not take any more debts out and do not put your name on them!!
Bankruptsy should be the last resort please get him to go to the cab!0 -

I often wonder this too!
Seriously, getting married to someone does not make you liable for his debts. Don't put anything into joint names!
I agree, he should sort his debts out first before considering marriage.Ær ic wisdom funde, ær wearð ic eald.

I dont know. But if you really want to marry, get proper legal advice and take whatever action you need to secure your own money. Also, think why he has so much debt, you sound a bit unsure of his financial reliability. £13000 is a lot of money, presume he has something worthwhile to show for it ?
Safeguard yourself and do it before you marry.
Further down the line, if you have kids, etc. and you split up, you may need to be sure you have a roof over your heads. Hopefully you have a long and happy marriage and he sorts out his debts (out of his own money !!!)0 -
Hi all.
Sorry, by 'they' I meant his creditors. Although it would be nice to sort out the debt before marriage, if this wasn't possible I just wanted to check that getting married wasn't going to jeopardise my house.0 -

Hi Cleg!
Not sure what you mean by "if this wasn't possible". Surely it's a voluntary thing and you just don't do it till you're debt free? (Maybe, if he's a bit 'relaxed' :rotfl: about the situation - not saying he is! - it'd give him a goal to aim for?)
£13000 would pay for a fair wedding!A budget is like a speed sign - a LIMIT not a TARGET!!

Why not sign a pre-nup to cover the house?0

I'd post this on the Bankruptcy Board as there are people there who actually know what they're talking about.0

As has been said they cannot take your house for his unsecured debt.
Dependant on his salary he can either make an arrangement to pay his creditors or he can use the new debt relief orders that are due to come in, in april 09.
Either way he needs to seek the advice of a qualified money adviser.
Good luck with your impending nuptials
