Council Tax Arrears

I dont know if this is the correct forum but any help would be appreciated.
Basically my mrs owed council tax and an arrangement was in place paying it back at £50 a week for nearly 2 years, which brings the payback to £110 a month & £160 on a 5 week month.
Just before christmas the female employees of the council (of which my mrs is one) recieved a payout because they werent recieving the same as men, the council wanted this money from my mrs to pay off some council tax, my mrs told them no chance as what was being paid would clear off any debt in under a year and we needed that money to pay other people.
This morning myself (wasnt even my debt) and my mrs recieved a CCJ for council tax arrears even though an agreement was set up and it has never been missed?
They have sent on our arrears to a debt collection agency even though an agreement was in place and would have been paid within this year?
Are they doing this out of spite and if so do we have any comeback?

You wouldn't get a CCJ for Council Tax arrears as Council Tax is dealt with through the criminal line (magistrates court) rather than civil (county court).
The Council will have applied for a Liability Order to allow them to take further recovery action (initially a payment arrangement, bailiff, attachment of earnings/benefit).
You need to speak to the council to determine why the Liability Order was awarded. If the payment arrangement was agreed after receiving a court summons then the council will usually still apply for the Liability Order in case the agreement is defaulted on.
Technically once the council have the liability order then they can pick and choose the recovery action from the list allowed and can change the recovery used at any point of their choosing providing there's still an outstanding balance.Basically my mrs owed council tax and an arrangement was in place paying it back at £50 a week for nearly 2 years, which brings the payback to £110 a month & £160 on a 5 week month.
Was she paying the agreed amount or have you misposted your figures ?I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
