Hello,
I have just had a letter from the council asking for nearly £300 by the end of January. It appears that they have decided that I am in the wrong tax band and are claiming the extra charge for the year I have been living here. Can they do this ?
Also, I asked the landlord initially what the council tax was likely to be before moving in and they quoted the amount I have been paying up until now, do I have any rights surrounding this ?

Unless you are in Scotland, it is not the council who determine the CT band, t is the Valuation Office Agency. You should have received a notice from VOA saying your band has been increased.
Without knowing more details, it is difficult to comment on legality of extra charge. You should check with VOA (address/phone no. on CT bill or on VOA website) why and when CT band increased, and the effective date.
If you asked LL what CT was likely to be, then what he said was not incorrect. If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -

Hi, I had a letter on the 12th of Jan saying that it was being changed due to a code 8 (property partially used for non domestic purposes and is now used wholly for domestic purposes and is therefore now only liable for council tax)
The effective date is 1/10/07.
I moved in exactly 1 year ago and this has always been for domestic purposes.
I am the first tenant in this ugly new build.

Something is wrong somewhere.
If it is a genuine new build, i.e. brand new construction, then I cannot see that there would have been any partial non domestic element. Had it been a "showflat" prior to your occupation, then it would have been wholly non domestic. The Code 8 would usually be used where, say, a house with shop, has shop part converted to living accom. What was previous band and what is current band please? If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0
