suspended from work.

I recently returned to work last week following an accident at work, on meeting with the management yesterday they informed me that they would not give me a warning about the accident but asked me to sign a file note which would be kept on my work file, the note they wanted me to sign said I admitted liability for the accident. I informed the management that I didn't want to sign this document as I wasn't at fault. They said they were not sure what the result of me not signing the document would be and I may be disciplined. When I arrived at work this morning two managers were present (they normally don't arrive until later) they called me into the office and suspended me saying they had watched footage of me yesterday not adhering to health and safety rules. Thus being not pulling the shutter down on the loading bay. When I asked if this was anything to do with not signing the note yesterday they "no" we always check the footage of the warehouse, which they do not as all the people on my shift never pull the shutter down on my shift and we have been doing this for around 2 years including managers. I definitely think I am being singled out and victimised. Any thoughts or advice would be welcomed on this matter.

    sue them for the accident :)

    i think this is a two pronged attack , they cannot fire you for not signing a document but they can do you for not following health and safety and as im sure if everyone leaves the door open they know what they can do you for

    all they want to prevent is you taking them over the coals over your accident

  • One question...

    As a HGV driver, my experience of loading bays is that the greem light for us to pull off doesn't actually come on until the roller shutter doors are closed so does this mean you have lorries pulling off bays on a red light? I ask because I have seen and heard of far too many accidents where lorries have pulled off on red lights only for some poor sod who is on a forklift or electric barrow to end up coming off the rear of the trailer and falling 3ft. In a couple of cases, this has resulted in very serious injury and death.

    Did you ever sign a piece of paper saying that you were trained about the Health and Safety procedures at your place of work?If not how can you have known that you were supposed to close the shutters whe all you were doing was copying everyone else?

    Did you have the necessary training from your company as part of your mandatory induction? If not, and they haven't subesquently offered it they are at fault for not training you.

    If you have had the training, or been offered it and not done it, then you are at fault if you have not followed correct practice.
