Maternity leave and Holiday pay

Sorry if this is a really obvious question, but everyone here seems so knowledgable and I just want to know where I stand.

Im currently on Maternity leave and am accruing holiday days (11 so far). If I dont return to my job at the end of my Maternity leave then am I entitled to be paid for these days just like I would if I had been working?

Also, I am entitled to a bonus in March, can my employer withold it as I am on maternity leave?

  • Up to the date you leave your company you will be accruing Holiday Pay at full contractural rate.
    You would expect to be paid these days if you didn't return.

    Bonus schemes have their own rules. You say "entitled" to so I assume this is not a discretionary bonus. In that case I think it could be considered sex discrimination if it was withheld from you while you were on maternity leave.

    I think it is usual to accrue annual leave whilst you are on paid maternity leave, not when on unpaid maternity leave. Not sure about the bonus.
  • Any woman on Maternity leave continues to accrue their full holiday entitlement. This is UK legislation. It changed on 5th October 08.

    Before 5th Oct employees on Mat leave would recieve full contractural Hol Pay for the first 26 weeks and then Statutory holiday pay until they returned to work (or resigned).
