A question for Addicted to Chocolate

Sorry to be so specific and ask for you by name, but just a quick question and I'm thinking you are the best one to ask.

I declared bankruptcy in May of last year. At the interview with the examiner, he did mention that it is possible I may get called back for a second interview if they had any questions.

So my question is, after nine months, what is the likelihood of this happening to me? I know you can't say in my specific case, but in your experience have i gone past the "date" that I would be called back.

  • Hi Kevker. So you have not heard from the OR since when? if you are nine months into your bankruptcy I would say you are unliekly to be called in again for reinterview. There is nothing to stop you from ringing tthe OR's office and asking what stage your case is at. If you have not been called in for reinterview within 6 months of your first interview i woud say very unliekly they are still investigating your case.

    Well, I had my interview on 19th May last year. Only time I have been in contact since then was to do with my Income Tax (which still is being taken from my wages). Other than that nothing. Just seeing that date brings it home to me how close I am to being discharged and I can't believe how quick the year has gone. Thanks A2C.

    You may have already been discharged.

    It depends on offices but the target is for 60% of people to get early discharge.

    If you haven't been discharged by the 9 month stage you probably won't be discharged until the 12 month aniversary. I think it is actually that if discharge hasn't been done by 10 month is goes to the automatic 12 month discharge (simply because it takes time to go through so there is no point starting the process after 10 months).

    I'm not quite sure of the exact timings as it is not the part I do.

    If you are going to phone up to see how it is going, it is very easy for the examiner to check if you have been discharged, it is harder for them to say if you will get early discharge.

    So following on from that train of thought, if I was going to get a BRO, I'm assuming I would normally have heard about that by now? I really think I am just being paranoid as my discharge date looms, but I don't really want any surprises.
  • i really think if you were being targetted for a BRO you would know about it, you would have have been reinterviewed and questioned about one particular thing: eg repaying a debt to a family member in full, gambling, obtaining further credit with knowledge of insolvency, disposal of assets to family or at less than value etc.....
    if you have only had the regular first interview ( where they go through the statement of afafirs and ask additonal questions, establish cause of insolvency etc) then you are not targetted for a BRO I would say.
