holiday entitlement

hi at my current job i get 13days holiday and paid bank holidays i work 5 days a week, our holidays run from jan to jan was just wondering as the holiday entitlement went up to 24 days last september should i have got the extra days last year

i mean to say should i have got the extra days when the entitlement went up to 24 days in september, or should i have just got the 21 days that i did becouse my holiday year starts in january0 -
The statutory minimum entitlement went up on 1 October 2007.
For a holiday year which doesn't start on 1 October you need to work out the proportion of the increase which applies to your holiday year.
For the year of January to December (inclusive) 2008 you would have been entitled to a total of 24 days.
And that would mean that in 2007 you would indeed have been entitled to 21 days as the increase was 4 days and October to December is a quarter of a year.0 -

Absolutely. As long as you work 5 days a week you would have been entitled to 24 days in 2008.
Good news - and from 1 April 2009 you wouldl be entitled to 28 days on the same basis. So, the pro rata increase for someone whose holiday year runs with the calendar year, would bring the holiday entitlement be 27 days in 2009.0 -

Yes.
OP said 13 days holiday and paid bank holidays. That totals 21 days.
So the 24 days and 28 days also include (as they may) bank holidays.0 -

Does your company shut down at Christmas? If so, this could be why you were only given 21 days to take as holiday. Our company shuts down for 3 working days over the Christmas period and this taken from our yearly holiday allowance, so I myself only had 21 days to take at my own leisure, the same as yourself.0 -
yeah we shut down for a week but i only got paid for the bank holidays. i guess i should have a word with her.0
