Leaving a job--some questions

My friend's son is leaving his job without notice, this friday. No way round this as he has a better one to start but has to start on monday.
The company he's with is well known for witholding holiday pay and P45s if an employee leaves suddenly. He realizes he might lose his holiday pay but what happens re his P45 ? How long does his employer have to forward it to him? What can he do if they don't ? Will he be on emergency tax until they do ?

  • I believe an employer has no right to withold a P45, as it is ilegal, but I'm sure someone will be able to explain better.

    Difficult to say. I imagine he would get it threw the post with his last paycheck. Until then he will be on emergency tax unless its corrected. You might be able to sort it out by phoning the tax office directly but you will need to know your salary etc.

    he can self sertify with new employer on P46 if he has his last wage slip.
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    You do not need a payslip to fill in a P46, in fact all new employees who do not have a P45 should be given a P46. This will result in this case in the new employee being put on 603L week1/month1 emergency tax. The tax office will eventually advise his new employer of his correct tax code and pay and tax details, if need be by writing for these details to his old employer, and then any overpaid or underpaid tax will be adjusted in his wages.
