  • you can try the social for a crisis loan you dont have to be on benefits to apply. as with the energy companies there have been many on here that have tried applying but have been refused, i would get a form from the social and try that as with the energy companies all they can say is no.

    they wont give you money towards a br but will help you with everyday costs ie food/bills while you save for the br fees

    How much was your IVA for per month, and can you not save that amount for a few months and add it to the £100 you have saved?

    Basically, if you do not have the fees to pay for your petition, you cannot declare yourself bankrupt.

    My IVA is £300 pm. But since a few months ago it has been cutting into my rent and everything else. I've been running on the basics anyway. So if I came off the IVA and used that money for a BR will my creditors be ok with that? I mean will they not file for legal action or anything in the meantime?
    It might take a month or two for that since my wages for this month aren't due until the 28th.
    Also what if I am made redundant for some reason? There has been hundreds of job cuts in my company recently. Hence my concern.

    If you are made redundant and claim JSA or the like, then you would get the court fees waived - thats £150, but you still need £345 for the OR fees (payable at the court on the day).

    Stuff what your creditors think!!! Its highly unlikely your creditors will make you BR - they may well create a sing and dance about it, but unlikely (highly) to ever do it. They may file for CCJs but not BR - it costs them far, far too much money with a high risk that they will get nothing at all so its not worth it to them.

    Your IVA may have a BR clause where your IVA covers the BR costs, so check out your contract. Also, some county courts require a certificate from your IVA company to confirm the IVA has failed. But this can take a long time, so phone your local county court to see if they definitely need the certificate (some insist, others don't).

    How bad is a CCJ? If I came off the IVA and didn't pay anything to my IP for 2 months and then went into bankruptcy will that mean I have to appear in court or pay them any fees etc? From what I have observed CCJs seems to carry fees payable to the courts.

    if your iva was 300 and you need to make 345 up to go br you onlyhave to scrimp for 1 month with what u have saved so far and you are there!
    do not worry about the creditors the main worries are roof over head and food for starters.

    ring cccs ask for help tell them you cannot afford iva and you think you need to go br they will either arrange another call back or put you through to the br helpline

    first thing first do the statement of affairs (soa) so we can look at you spending / debts
