DCAs and Bailiffs

Does anyone know if debt collection agencies are entitled to send bailiffs for unpaid consumer debts? Do they have to have a court order or can they send bailiffs anyway?

    They have to have a court order. You then have to have failed to pay the court order/instalments as directed by the court. They can finally then apply to the court to send bailiffs.

    To be honest, at every stage you have ample opportunity to see that it doesn't happen.

    For example if you can't make payments ordered by the court you can apply to get them changed. If you get notice that bailiffs are being instructed, then you can apply to stop this. Plus you don't have to let bailiffs in. ;)

    So bailiffs are in theory possible, but I can't think of anyone here who has ever seen them over a "consumer" debt.

    DCA's may threaten to send "debt collectors", but these have no legal power. You just tell them to "naff off". :cool:
