Trouble with partner, assets and bankruptcy forms

Hi, i'm in the process of filling in the forms online but my partners been "hearing things about bankruptcy" IE: their going to make him pay my debts, their going to take his car, the telly and the furniture ect. so he doesn't want me putting his income or anything on the forms. We do live financally seperate, he pays the rent and the council tax and i pay everything else, all the debts are mine, is there any way i can go bankrupt totally on my own without them taking his earnings into account? or involving him in any way? (I did tell him if its that much of a problem he can always move out but he didn't seem to keen on that idea!)
also, i'm really not sure what to put on the assets section of the forms, i don't own anything expensive like a car but i do own my furniture (athough its all second hand and has broken bits and flaws and i've got a ps3 but it jumps a lot), my partner recons i have to write down everying i own, even my clothes and bedding? if thats right then i'm going to need a lot more space on the form as i'm a horder... thank in advance, Alice

    Hello Alice,
    If the debts are in your name only, then the creditors cannot approach your partner for payments. If there are any debts in *both* of your names, then he will be liable for those debts when you're declared bankrupt. Regarding the income and expenditure on your bankruptcy petition, you will have to put down your partner's contribution - nb not his entire income - to the household finances. Regarding assets, the only household items you need to put down as assets are those worth over £1000, ie the famous 45" plasma tv that all bankrupts are thought to own (!) or any valuable antiques or computer equipment. nb if the computer equipment is necessary for work, it will either be exempt or you will be invited to put in an offer to effectively buy it back from your OR.     Alice, I think your OH needs to sop listening to people who are telling him BS!

    Nothing from your house is boing to be taken, they cannot ask him for a penny towards your debts, his car is not going to be taken. You have to out his contribution to the household bills on the form, that's all, they have no right to know, and will not ask how much he earns. All they need to know is that he is contributing his fair share to the household and that you are not paying for everyhting to avoid an IPA.

    As for assets, unless you own a house, car, or expensive antiques you put nothing in that section.

    Now go kick your OH and tell him no to be so stupid as to listen to people who do not know the facts about BR.:D

  • Excellent, thanks for your help (and reassurance) i've been trying to fill these forms in for weeks and the stress of it all made me ill, just getting better and HE starts wanting to get involved, i do have a computer, bought from kwik save for £500 about 4 years ago but i do need that for my sons school and home work and i'm starting collage this evening so i'll need it as well, think i'll be allowed to keep it?

    An expensive up-to date computer that will fetch a good few hundred second hand. Yours would be suitable for freecycle, so do not worry about it. it is not an asset as far as the OR is concerned.
