Joint petition - how do we put SOA together

Hi there, my OH and I are going to court on Thursday and are just finishing off the paperwork. We are each handing in our own forms as we have a number of joint debts and are going BR together.

When calculating our income/expenditure, say our rent is £1000 per month, should we half that and show half each on our forms?

Would it be easier if we both posted our own SOA together, and perhaps you kind people could comment?

    definitely post your soa up here and it will get tweaked about by all! but household bills do get split 50/50 if you are both going BR.

    Household bills go on in full on both petitions and then you put personal expenses down.

    You put your full wage on yours and your partners contribution to the joint household bills. On hers you put her full income and your contribution to the joint bills.

    You have to do your own SOA's as bankruptcy is persona. Hope that makes sense.

  • Also another (I hope not completely stupid) question - but I assume that we include all of our debts on this form... in fact I know we do... it's just that as we have not been paying them for the past couple of months while we save for BR fees it seems like they're not there!

    I'm going to post this if only to highlight what a pickle my head is in with all this!

    its ok, my head was pickled and still is whilst awaiting contact from the OR. but do put all debts down, even if you do not put them all down they will come to light once the OR puts the notices in the paper etc.

    Both me and my OH went BR at the same time recently, as a joint BR.

    We put all of our joint income together, all of our expenses household and personal together, and then duplicated them onto one anothers BR forms.

    The only things that were different on the BR forms were.
    On mine i put my full income in "what is your average monthly take home pay" and my OH's full income in "how much do other members of your household contribute each month to household expenses", and then switched them around on my OH 's forms.

    Make a note in the back of the BR forms along the lines of, "we worked our income & expenses jointly as we are both declaring BR."

    You must include your own personal debts indiviually, plus any in joint names and the same obviously goes for your partner.

    This is what we did and our BR went through without a hiccup.

    I hope this post doesn't come across as condescending, as its not meant to be, i'm just trying to explain it as easy as possible.

    The correct way is the way we have explained to you. It is to do with bankruptcy being an individual thing.

    I would not dismiss any other posts on here but i'm only passing on my own personal BR experience, and what worked for us, elsewhere in the country things may be done in a different way.

    We were advised to fill in the forms that way by our local Welfare rights, who have an office in our county court.

    Welfare rights looked over our forms on the day of our BR to make sure that they had been filled in correctly, something that our local county court strongly advises is done by Welfare rights before handing the BR forms over and paying the fee.

    If you have a Welfare rights office where you live it might be worth popping in to see if its the same situation there.
