I saw another thread and it reminded me but I didn't want to hijack it.
O/H has debts. When he fessed up the first thing we did was withdraw the cash in his Lloyds/TSB account and close it ( cos the bouncing direct debits were out of control ). When I went through his statements Lloyds had charged him over £ 600.00 in a four month period. Now I know there's a process whereby you can challenge and ask for a refund of these fees ( and I'm not getting into the morality of this here ). However there are two problems with his ability to do this :
- He only has statements for 4 months. He did the typical 'head in sand' throw away everything scary approach. I am sure these charges were over a longer period. How can he get this information ? Don't say ask Lloyds because, apart from charging, we asked them 9 times for a list of direct debits on the account ( to establish who he owed ) and never got the info, always about to do it.
- The account is closed. Does that matter ?
Also what period is the norm, in looking to get a refund on charges ?

Debt at highest - £97,000 :eek:

LTSB are legally obliged to provided the account statements for up to 5 years after the account is closed, therefore in your situation the provision of the information should be relatively straight forward.
in true terms there is no "limit" on how far you can go back, but if you waited over a year and the matter did escalate to a court claim ( exceptionally unlikely they normally roll over) then you may be asked for an explanation as to the delay.
In the first instance ask them purely for the account statements, if they fail to comply within 14 days then issue a SARN notice ( Subject Access Request Notice) they can charge you up to £10 for this, but they are then legally HAVE to provide ALL information and personal data relating to the account.:rolleyes: It’s hard enough remembering my opinions - without remembering my reasons for them :rolleyes:0 -

Is the SARN notice something we do ourselves when writing ie put it at top of letter ( assuming they don't provide when first requested ) or is it a specific 'form' we get from somewhere ? Also do we send a £ 10 cheque or wait for them to request it ?0 -
Just go into the branch and ask them
They may complain, but the branch will probably look on it as £10 for a few pieces of paper that are in the computer anyway0 -
ive requested stacks of back statements in the past few years and ive never had problems i just phoned them they charged me a tenner and i got them in the post within a week .. thats about the only thing llodys have ever managed to that was nice !!! and i have also had hundreds of pounds charged in fees etc so i will be watching this post closely to see what happens!! :-):EasterBun ...what more do I need to say?!
