To be honest that is something that really gets my goat. I don't see why I should be 'fined' because my ex has kids. Whilst I will do anything for them my income shouldn't be taken into account.

Although this being said he is on the new system, and we haven't been asked for my details.

Sorry to butt in but did i read it correctly
that if the children live with the mother and the husband moves in with someone else thier income is not taken into account.
The reason for checking on this is that my partners ex has said that if he moves in with me or anyone else for that matter then she wants more money off him.We have been asking the csa if this was the case but as usual no reply.

Bigun - if your partner is on the new system, the CSA won't ask you for income details. Your partner will just pay the set percentage ie. 15% of net wages for one child.

However, if your partner is on the old CSA system, they will ask for your income details. The CSA will work out a maintenance figure on your partner's income only. He will not have to pay more than this figure regardless of your income. However, with your income details he may have to pay less than the assessed figure, because he may have to pay the majority of household expenses etc. if your income is low.

This is how I understand it to be anyway.... although I admit, on the old system, figures do appear to be plucked out of the air.

Hi all just a quicke - my step-son was 16 in June - started a job now...is my husband no longer liable to pay maintenance for him through CSA? Also step-daughter started 2nd year at college doing A Levels, she will be 18 when she leaves to start UNI, is CSA payable when she goes to UNI? Im a little confused as on their website it says up to age 19 studying up to A Level, well shes doing that now so once she leaves college in September next year am i right in thinking her CSA will stop too?

    thanks

Once your step-son starts a job then your husband will no longer have to pay CSA maintenance for him, same applies when your step-daughter leaves college for university.

Basic rule is once child benefit stops being paid for a child then maintenance stops too.

pretty sure maintenance stops at same time as child benefit, so the september after they leave school is when it stopped for my daughter, also she went to uni and i couldnt get maintenance then, not that id had it before but i know she was taken off my claim for maintenance that i have for my 2 other children. wont be long now till they leave school and still never had a penny

Well me and my partner are on the new system and they have definitely taken my CTC into account.
We queried this before and was told it was correct.
Can anyone tell me if my partner changes his job in the future does he have to inform the CSA?
    :)

So basically if child benefit stops in September - hubby doesnt have to pay through CSA for eldest lad...........eldest girls leaves college next July and presumably Child Benefit will continue to be paid until the September. She is going to Uni this time next year so her CSA will also stop then?

Yes CB will stop as it is not for higher education but further education such as A levels etc.

The CSA claim will be closed. If he wants to pay any money that is up to him.

Yes thanks I know how they work it out well and on their website it will tell anyone thats interested how they work it out.

Your quite right that theres no requirement in law for a partner to provide income details BUT the consequence would be an category b interim maintenance assessment which is a penalty assessment and higher than the regular assessment would be.

All the information is on their website - free and available.

And I presume when you say 'they pluck numbers out of thin air' youre talking about the MP's that actually put this stupid law in place in full detail ??

Even when my husband refused the to give them my wage his payments did not go up by much. So find it BS. And why should I give my wage the PWC does not have to give wages and neither do their new partners.

And yes thanks I know how they work it out as well. On the old system if you are on it is very complicated and unless you have degree in maths is hard to follow and even work out.

The reason I say they pluck numbers out of thin air is that my husband gross wage went up by £3K which after tax is not a lot extra. He had a child come off the system and his csa payments tripled. We expected it to go up a little due to the extra wages but tripled

It is not like he was earning that much and I was not earning at that time.

Ok we have had problems with the csa for the last 3 years - we pay £200 per month for my wifes 2 children that live with Dad - we are on the new system so they just take my wifes wages - we have the kids every weekend without fail so get some money off for this - We worked out 2 years ago that the csa had worked out my wifes wages wrong and were charging too much so we phoned them every month since then trying to get it sorted out - this has never been sorted - My wifes ex is on income support so he doesnt get any of the money we pay directly it just goes to pay his benefits.

Now yesterday my wife had a phone call from the CSA telling her to STOP paying immediately. When asked why she replied that her ex had told them in 2004 that they have a private arraingement (i didnt think you could do this if he was on benefits) it has taken them this long to realise we were still paying - the only thing is we dont have a private arraingement apart from the fact that we buy all there clothes and school stuff but we do that ontop of paying the csa - are csa making a mistake? we phoned them back and spoke to a chap who is saying the same thing - they are going to put the over payment back into our bank but we are worried as we know what they are like.

any help would be very much appreciated.
