Redundancy notice period

Hi, just wondering if someone can help. I've been with my company for 10 years and may be facing redundancy. My contract says my employer should generally give one month's notice (not specifically referring to redundancy situations). Stuff I've read online suggests I'm entitled to 10 weeks notice. Which is correct?

Also, is annual leave accrued on top of the notice period and payable?

  • I've just had a read up on it here and it sounds like the legal minimum is 1 week for every year you have worked there - they would only have to give you the notice period in your contract if it is MORE than the legal minimum . Technically they don't have to give you the notice 10 weeks before it happens, but they have to pay you for it, so if I was in your situation and went to work on Monday and they told me I was redundant and sent me home again that would be fine, but they would have to pay me my 10 weeks notice IYSWIM.

    And I believe that annual leave is still accrued through the notice period, and they have to pay you for it (you do get taxed on that bit though, but not on the redundancy payment).

    If you've worked for the company for 10 years they will have to give you 10 weeks pay (at least!), as your redundancy payment and that is tax free up to £30k.

    There is a section on the ACAS website here which has info on redundancies, with links to leaflets and things. You might want to have a read through and make sure you are being treated fairly etc :)

    Calculation is based on age, length of service and amount of pay. Note that the pay is capped at £330/week and is not your actual pay if that is more.

    That's great thanks. I think this means I am due 10 weeks notice (or pay in lieu of notice) at full rate of pay and then 10 weeks redundancy at £330 p/w. Thanks a lot

    I was made redundant from my company in August after nearly 12 years and was on 11 weeks' notice plus accrued and carry over holiday.
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)
