another question

On the forms it say...."In the last 2 years have you made any payment to a creditor, other than in the ordinary course of business, with a view to improving the position of that creditor in case you became subject to insolvency/bankruptcy proceedings?"

When i first got into trouble i recieved many "threatening" calls from 2 of my creditors,and i did make payments to them that were not part of my dmp.Do they need details of this on the form,i am a little confused of what it means..

    yes they were, they were threatening legal action etc..and i just panicked into paying a bit extra, mainly thanks to my wife.
    I wish i knew then that most of the threats were false, but i was just too scared i guess

    That was really naughty of that creditor to ask for more money when you were in a DMP! Its up to you really whether or not you say you did pay them. How much did you pay? Did it come out of your bank account? If it was a relatively low amount and you told the OR you were panicking because of their threats of action I'm sure you would be okay.

    I paid it by debit card, it was about 3 payments of £40?? to mbna and about 3 payments of £10 to barclaycard..

    In that case I think the OR would realise you were scared into paying it and there shouldn't be a problem. If you had paid half the debt off or something that would be a different story. I'd be really angry with MBNA - well I am anyway! and to Barclaycard for taking advantage. They must have agreed your DMP in the first place so why did they want extra? Greed!

    They did agree to it, but i kept getting call after call, and just caved in....

    So, i do need to put these payments on my forms???

    If you read the question literally then no, you didn't pay them 'with a view to improving their position'. I would definitely not put them down if they were my forms. You paid them not to improve their position but because they were threatening action against you. Clear cut!
