MBNA getting heavy

Hi all,
I have been on my DMP with CCCs now for three months and making regular payments to all my creditors, one being MBNA personal loan. They have pestered the life out of me saying the amount I have been paying is not enough and asking for at least another £9 a month. I have submitted my SOA to both CCCS and MBNA so they know exactly how much money is available, yet they still pester me asking for more money.
Today I received a letter demanding more money to be paid by 5pm on 15th January otherwise they may issue proceedings against me for the outstanding debt owed. If they are successful in obtaining a CCJ then they will apply to the court for a charging order to be entered against my property, an attachment of earnings order, and that my income and expenditure to be examined in court.
Now I am worried, what do I do now? I am told if I pay them anymore than on my DMP I will be in breach with CCCS arrangements. I certainly dont want a charging order and also dont want my employer to know about my situation.
Does anybody have any suggestions? :eek:

This sounds like a threat to get you to pay more. I've had similar with one of my creditors. You have to treat all your creditors fairly and they know that.
If it did go to court, the judge would probably look favourably on you that you are making every effort to pay your debts off and either fix the payments on what you are paying now or even reduce them. You could always argue that MBNA going for a CO would be unfair on your other creditors.
Please don't pay them any more and ignore them. Speak to CCCS on Monday and see what they suggest. You could speak to National Debtline in the meantime though to put your mind at rest.

Go back to cccs and send MBNA the letter that makes sure they cannot contact you by telephone!
Are you keeping their letters? Show them to your CCCS person and ask what to do.
MBNA are b@stards and once you give in they'll just keep asking for bigger and bigger amounts

Hi, thanks. Yes, I have kept every letter and even made a record of the phone calls. In fact, last time I spoke to one of their "advisors" I found them quite arrogant. You'd have thought I owed the money to her personally! They have no sympathy with my financial problems whatsoever and dont listen to whatever I have to say on the phone, just keep saying they must have more money. I will contact CCCS on Monday and maybe send them a copy of the latest letter.0

MBNA are foul to deal with...so rude and obnoxious! they threatened me with a charging order on my property,even sending me the land registry details about my flat..my cccs counsellor told me simply that "they can't get blood out of a stone".how true!"happiness is...positive cashflow!":j0

i was under the impression that mbna are strugling?!
i too am on a dmp with cccs and up until dec last year had a cc with mbna, they were always hassling me about paying more etc then out of the blue offered me a f&f which i even managed to negotiate a smaller amount!luckily i got the f&f money together and got rid of them but i have heard a lot of people haing similar things happen with them and mbna so i think they may be struggling!
We ended up with a c/o from egg and at the time i culdnt have thought of anything worse but tbh it isnt that bad, really!in a way oddly enough its caused us a lot less stress we tried to argue the co with cccs's help but it didnt help and it got set at the amount we were originally paying not the amount egg were wanting u to pay which in itself was a relief! they never asked for an attachement of earnings or anything so no-one knows about it except me my dh and you guys! sorry realised i rambled a bit there! hope that helps you a bit anyway!0 -

Firstly, a CCJ is binding on them as well as you, so as long as you fight your corner re the actaul monthly payment, it is not bad thing. They also have to stop charging interest.
If you keep to the monthly payments as per the CCJ, then they cannot get a charging order, as per Mercantile v Ellis. However a lot of people on here find that judges take no notice unless they are reminded of the court case by the creditor.
The creditor will try to vary the CCJ to get a forthwith payment and then a charging order, because it allows them to secure the debt (which makes their business more secure) and they can charge 8% interest on the debt. You will need to keep your wits about you and fight each step.

We have a couple of debts with MBNA and they are offering around 50% full and final settlement.
Dont pay any more just because they are putting pressur on, if you have done a budget of income etc with CCCS, and now paying your monthly amount you show you are being reasonable and paying what you can.

MBNA are being really bad with me. They get a collection agency called Aegis to contct me. On average I get around 4 calls a day and 3 letters a week.
I'm always in the brown stuff (marmite)....only the depth varies!!! :rotfl:0 -
Yep, I was under the impression that MBNA are struggling.
I'm on a dmp with CCCS and they are my largest creditor - owe them about 9K. Since I started my dmp this time last year, not heard a peep out of MBNA apart from a default notice last April and a letter in November saying they have re-scheduled my payments (probably to make it look better for shareholders as they wouldn't like to see bad debts on the books) and that's it. Looks like I'm in the minority or maybe MBNA are saving everything and hit me with a massive onslaught soon.Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free

Bank Of America are struggling, of which MBNA are now part of. BoA have announced job cuts of 30-35,000 or roughly 11.5%.
Almost all recruitment has gone (except essential areas), people essentially had pay cuts due to no overtime, no incentives etc. There has been no confirmation of any numbers in MBNA (who knows, they could get rid of everyone and ship everything out to India or far east (where BoA also have offices.)
BoA have basically bitten off more than they can chew. They tried to do the same as they did in the late 20's - buy-out (or "rescue") other businesses. They paid over the odds for La Salle and for Meryl Lynch and took on all their debt, and now, lots of sticky stuff has hit the fan.
I am not too worried about my job, but I wouldnt be unhappy if i was one that got redundancy from it (not that I would get a massive payout)No Longer works for MBNA as of August 2010 - redundancy money will be nice though.
