Hi, I need help with a few things please. :)

I hope I am in the right place and I can get a little bit of help.

1) I went bankrupt on 1st October and have a car on HPi that is due to be collected. This has still not been done, so is there any sort of time that they have to collect it in? And if they don't am I allowed to keep the car (albeit broken at the moment.)

2) The car above was repaired last year, but the work was not carried out properly, so I was going to take the business to court over it, but now I have gone bankrupt I can't do that as all the money will go to the OR, so is it possible that my wife can take them to court as it was both of our funds that paid for it to be repaired.

I think there was a third thing I wanted to ask, but it has slipped my mind, so if you could help in anyway then that would be great!

    They can take as long as they want to collect it. I seen them take 9 months to a year on hear. There is a way to get them to collect it quicker but I can't remember what it is right now. Hopefully someone can give you some ideas later.

    I am assuming that as she is not BR she can. But have the HPi company come after her yet for the shortfall, beware they may. If she does take them to court and gets the full amount the OR may have an interest in your bit.

    Have the HPi come after my wife for the money do you mean? If so then no as the car is in my name and it was me who went BR. I needed to know as the car is in my name and the work carried out was also in my name (the invoice etc.) if she could take the company to court or not? I thought she wouldn't because that there was no proof that she had any dealings, monetary or otherwise, with the car. Does that make sense to you?

    If the car is in your name, she cannot claim.

    You may need some advice re any possible liability for debt incurred after bankruptcy.

    if you want to get rid of the car, at least one OP drowve it to the forecourt, left it there and posted the keys through the door.

    Are you allowed to keep paying for the car on your SOA?
