CSA: Ex won't pay for childcare

My children stay with my ex 2 nights a week: one midweek night, and every other weekend. The CSA have calculated his maintenance based on the 2/7 reduction as he is deemed to provide their care on those days.

He is, however, refusing to pay for afterschool care on the midweek day that he has them. He expects to be able to pick the children up from me when he has finished work, so that I have to pay for their afterschool care at an afterschool club or sacrifice my own salary in order pick them up myself.

Effectively, I will be incurring costs for the children on these days, while he just benefits form having his maintenance payments reduced, and incurs no direct costs at all as the children simply sleep at his house overnight (he even expects them to be fed by the time he picks them up).

Can anyone provide me with any advice?

    The problem is the reduction is based on the overnight, quite ironic when you consider that this is probably when children cost the least !

    It is a double edged sword that some NRP's and PWC's use to their advantage.

    I guess that you receive the Child Benefit and are therefore able to add 80% of the childcare costs to your TC claim, whereas your ex can claim neither?

    Do you get tax credits for childcare?

    Do you receive the child benefit payments?

    If so, you do not have a leg to stand on here.

    We have my DH's child 1 midweek night and every other weekend, and are getting (eventually!) 1/7th reduction as it is actually 6 nights every 4 weeks. To be 2/7ths would mean the child stayed with your ex 1 midweek night and every weekend, so technically your ex doesn't have them 2 nights every week. If you informed the CSA of this his reduction should be 'reduced'.

    what is the actual cost, about £1.70p per hour ? as 80% is paid for isnt it ? if not look into it it should be

    If you have them 1 night during the week and every 2nd weekend (2 nights) then is this not 1 night week 1 and 3 nights week 2 so average is 2 nights per week so should be 2/7ths
    (unless you are counting weekend as Sat am till Sun pm in which case it is only 1 night)

    Sorry I didn't make myself clear. The weekend DSD stays is just the Saturday night. You're right, if the OPs ex has them for 2 nights at the weekend then yes it's 2/7ths.
