CCA Request - Cabot Financial

I recently was informed by Cabot Financial that they had taken over my Halifax Account. I sent them the standard CCA request with a cheque for £1. They have written back stating that they acknowledge receipt of my request but they are not obliged to provide this information and they have returned my cheque. However they say that they are pleased to help (!) and have requested the documentation from Halifax.

I've been paying an agreed monthly amount to Halifax and I'm not sure if I should continue to do this or not now?
Also I've also received another letter from Cabot saying that they've agreed for me to continue with the monthly payments (am guessing they got this information from Halifax), but I'm assuming that I probably shouldn't redirect the payment to Cabot, but I don't want to go down the CCJ route with them by not responding.

Can anyone please advise me where I now stand with this?

  • Speaking as some one debt free. I never paid cabolt as they were debt buyers . I made them chase me for as long as i could each time they reduced the final settlement figure all depends on how musch you owe?, and what financial position you are in . What you do not do is pay what you cannot afford.
  • Now that Cabot have bought the debt, and by the sounds of it, correctly sent you a notice of assignment, you shouldn't pay anything whatsoever now to Halifax. You are no longer their customer.

    What type of account was it? Credit card, loan or bank account?
    Cabot can now kiss my DONKEY. Statute barred is enough of a result, but the actions of the CABOT FAN CLUB have cost them far more than the paltry sums they were chasing us for. :beer:

    They own the Debt....they HAVE to provide the CCA. Doesnt matter if it is 'archived' down a tin-mine in Cornwall, its still their responsibility to provide it. And they suffer the consequences/loss if they dont........its their gamble! Debt buying is all just a gamble, they win some, they lose some, by fair means or foul ( on both sides:D ).
    Unfortunately you have to send the payments to this scavenging scum as they have bought the debt!

    Sorry to sound a bit thick, but should I start paying Cabot even though they haven't provided me with a copy of the CCA yet? Had another letter today saying that it was taking longer than they had expected to get the CCA and they would put my account on hold for a while, although they didn't say for how long.

    Although it may seem a waste of money, it is advisable to pay them.

    You could say that you are holding payment until such time as their entitlement to the debt is confirmed, and send a token ( £1, £5 ) payment in the meantime. ( but PUT IT ASIDE )

    Theres no REAL answer. I'm paying TWO DCAs full amount via CCCS, with the hope of reclaiming later....but not holding my breath.

    If 12+2 days have passed since you requested your CCA, they are now in dafault.

    The onus is on them to prove you owe the debt.

    Whilst your account is in default, they cannot add any further charges, if you contiune to pay them, they probably will.

  • It is in their interest to provide the agreement, so if there is one to be had, they will.

    If there isn't, they can't. But you will then be in a strong bargaining position.

    I would still tend to SAR Halifax and find out just how much of that "debt" is charges, and negotiate accordingly. In the case of my Barclaycard account, I discovered that the beggars owed ME money.

    I'm still having fun with that one 2 years down the line. :D
