hi! and before i start please may i say a big thankyou to everyone on this forum who have helped us with kind words, advice and most of all a good ear when needed.
this is a blow by blow account of the days proceedings for those who want to know
if it is not your thing please dont read it and state it was a bit drawn out.
we had our appointment at 10 am this morning my wife and myself
handed in the forms at the general reception 3 copies for both of us also included 2 of forms ex160 to exempt the court fees only you will still have to pay the OR fees of £345 for each application.
2 mins later she asks us on what grounds we want the fee exempted to which we replied low income , then it all fell apart lol! i will need 6 months statements for both main bank accounts now! bloody hell i didnt bring them and only brought enough money for 2 x £345 as well
she smiled gave us the option of coming back tomorrow or putting just one application through today.
she stated she would keep the forms there safe if we wanted to do it tomorrow
and we asked if we could go home for them she said it may put out all the appointments for the day and it would not be possible.
doh doh doh doh!
we then said we will go home see how long it takes then ring her to see if we have lost our chance.
35 min drive home rang her and all was fine come back in we will get it done for you.
woohoo
got back to the court. she only accepts cash, i still offered her a cheque but she just laughed and said rather have real money.
all forms checked, asked if the address on the front of the forms was current which it is not, so she just asked for proof of the new address and wrote them on by hand. job done.
just had to swear on the 'book' for my affadavit, then
we got our receipt then were sent to wait in a room upstairs.
10 mins later called into a court room. small one just us and the judge he was real nice, asked if we understand the implications of bankruptcy which we did he than said good because i dont answer any questions at all just process the form (okey dokey then!)
5 mins later he said all done please take all your paperwork back down to reception you are now officially bankrupt and are 1 of 2009 and no 2 of 2009, an ironic claim to fame!.
off down the stairs.
taken into a side room and papers taken back to be typed and sent to the OR who is 60 miles away.
told to answer the phone when it rings. 5 mins later the OR rang. he asked to confirm name (spell out loud please) and address then made another appointment for a phone interview (19 jan) then asked if we had any questions.
we asked about our 2 cars. he asked the value (600 and 100 £) and said would be doubtful due to the low value of them, however he would confirm in the interview.
He asked if we had a bank account that we had wages or benefits paid into that we wanted to keep - we do, so he is writing to them and hasnt frozen that one (but it is A&L so they probably wont let us stay anyway lol!)
He asked if we had any pending court hearings etc to do with home or debts within next 7 days, which we havent.
He also said if we get any grief off anyone to just quote our br ref number and they will back off immediately, and if they dont, direct them to him!
He was dead nice, and that was it, said he will send confirmation of everything out to us tomorrow, with some forms to fill out prior to the phone interview on the 19th, and off we went.
All of this, with a 4 year old, 3 year old and 10 month old in tow - and none of us were stressed or dealt with in a way that made us feel anything other than relieved and happy its all going ahead.
Thanks again everyone for help and support, if anyone has any Q's - fire away. Main thing we can say is it wasnt stressful, everyone was dead nice, just go with the flow but remember all your paper work ;o)

Marvellous - everyone seems to have very good accounts of the staff in the courts - they really do seem to be accommodating .....
Thanks for the account,
Good Luck to you all,

A similar thing happened to me with the EX160 form I arrived at the court with only the 345.00 and somthing like 5 months of statements the clerk was really nice and said due to the rules they had to see something like 6 clear months she did say not to worry what I could do was either come back the next day or if I did want the petition heard on the day she would hold the forms for me and advised me to go around to my local bank branch which was about 5 minutes walk from the court get them to do a printout and stamp it of transactions don't tell them it is for bankruptcy and come back to the court with it which I did
Good luck with your OR interview0 -
Hi Wallopadonkey, just wanted to say congratulations again. :T
Can I ask you one thing, you said you had the children in tow! Did you take them to the court with you? reason is, my OH can't come with me to court as he has to watch the kids, but wondered if you had your kids with you?
Thanks.

Congratulations !! It seems strange to congratulate someone on their bankruptcy. I'm sure it could only happen on a forum like this
. I'm glad to hear that it was relatively painless.
I'm still trying to pay mine off without taking such a step but I'm only one big illness or one largish, unpredictable mishap away from doing so. Although I work full time (self-employed), I have set myself a budget not much above benefits level to live on and I will be able to increase my income soon.
Hey-ho. Do my best and see how it goes I suppose.0 -
Wow talk about stress on your big day but im glad it all turned out ok and you should not be able to forget your numbers.:cheesy: K2nga :cheesy:

it really was fine.

thanks for that info, am considering asking the OH to come to court but I am not sure he will to be honest - and children to come but not sure how the court would take it to be honest. We have a 2 and a half year old and a fifteen month old, both boys! Will have to give it some more thought I think.
Have a lovely night and celebrate too! Kids toys get everywhere! I know!!BSC #215/No.1 Jan 09 Club0
