HSBC Managed Loan

I am currently on a debt management plan with CCCS. All of my creditors have accepted my monthly payment offer except HSBC. I was paying £299 per month but due to personal reasons, I am moving home and due to bills, can now only afford to offer them £76 per month as part of the DMP.

CCCS have been been paying the £76 per month but i am getting constant telephone calls from HSBC saying i am behind with payments, i have gone through a debt management plan with them to try and agree a monthly payment but they still refuse my offer of £76 and keep on with the nuisance phone calls.

When I did the DMP with HSBC last week, the lady I spoke to said my case would be going to Metropolitan in a month if I did not pay extra and I could try and negotiate a £20 per month payment with them (even though I am offering £76 which is being declined!)

I am worried that when my case goes to Metropolitan they may come to the house and remove goods (as my house is rented the household contents aren't mine) or take things of value of my partners - can they do this? Could they impose a CCJ? I am extremely worried about this and would appreciate it if anyone who has been in this situation with HSBC could advise me on what may happen with Metropolitan as I have never been in a situation like this before and am extremely worried.

    HSBC are often difficult to deal with but you are better sticking with the CCCS and referring them to CCCS.

    In principle they can apply to the court for a CCJ but as it will cost them money and as the judge will probably agree with the CCCS recommendation they are unlikely to do this.

    Bailiffs can only be instructed after a CCJ has been made by a judge and then only if you fail to keep up with the court's decision on monthly repayments and only then after a further court order has been made. If you have little of value there is anyway no point in them doing this.

    Also you can write to HSBC saying you only want to deal with them by letter and you will consider any further phone calls as harassment.

    Hi everyone, I would just like to say i'm new to this forum and sorry in advance if I ask any questions which have alraedy been asked and answered. I have recently been in touch with cccs after nearly getting into an IVA with a company who wanted money straight away and probably wouldnt have been able to get my IVA agreed (lucky escape). CCCS have been really amazing and advised me that an IVA would probably be a none starter due to the fact i get monthly bonuses at work which can be as high as £1000. They recommended a DMP and i am in the process of getting that set up after a phone interview next week. Following from commencing proceedings for an IVA myself and my partner have began sending token payments but haven't yet sent them to all our creditors. As i'm not as clued up about DMP'S yet as i was with IVA'S i was wondering if anybody could help me with a few general queries i have. Firstly - with a DMP do you have to include all creditors? as my gf is already paying an old univeristy debt to a collections agency which we did include in the schedule for the IVA (will they accept a reduced payment and will CCCS negotiate this like the others?).
    Also can you make additional payments over the agreed monthly payments from time to time (i.e pay extra from my work bonus)?
    What happens if a creditor doesn't agree to the DMP? do we then negotiate with them direct, seperate from the DMP and if so does this affect the DMP with the other creditors?
    Has anyone ever resulted in a CCJ from a DMP? my job could be affected if i got a CCJ.
    I think i've probably typed way too much already so i'll leave it at that. Thanks in advance fro your help and thanks once again to CCCS for the fantastic service they have provided me up to now. Good luck all in your goals

    i had all this hassle myself and cccs were great and metroploitain were fine about the cccs and as soon as i forwrded the accoutn number metro allocated me cccs just paid them no more problems just paying back slowly but surely. they cant just come and take everything with out you having the chance to offer a monthly payment first,
