Hi went BE in Nov havn't heard anything from OR with regards to IPA, at telephone interview she did say that because OH only just returned back to work they would probably wait until discharge before setting an IPA but still not sure what they allow as standard, on my I&E for the court I have not put anything down for holiday, entertainment, birthdays etc or emergency fund do they allow for any of the above, when going through I&E with OR she did say that all the figures looked ok apart from food she did say they allow £501 per month for 3 adults and 1 teenager, also car maintenance I put down £25 I don't think this is enough

Hi Queen,
did you post an SOA on here anywhere before going BR? You can put amounts for all the things you listed except entertainment and emergency fund (for some reason not allowed). Car maintenance for 1 car can be around £40. Why not put up an SOA on here and we can have a look - it's not too late to change the figures for the OR as if she proposes an IPA you can disagree with the figures if you think they're inaccurate. Best to have as much leeway in the SOA as poss!0 -

Now I am completely confused - I posted a question on this earlier and I was told that the OR no longer has an interest once you are discharged, but your OR is talking about setting up an IPA at the time of your discharge?
It is as clear as mud to me......

Sorry ment just before discharge0

Right, so I take it they are looking at ED? It wont take 10 months to establish his income, so that's good news I would have thought.

Not necessarily, SA. It just depends on how busy they are and how high you are up their list of priorities, unfortunately! It can take several months for them to sort an IPA, which will run for 36 months from the time it starts, not from the beginning of BR.0

My OH has only just returned to work from being off sick for the last 2/3 yrs he is still having tests but one of the conditions he has will before life not cureable but controlable so his income is not guaranteed although he returned to work 10th Nov only had one day sick but this is the most he has done for the 2/3 yrs0

Queen, don't worry about this until the OR asks you. Its pointless putting together an I&E or worrying about it right now when it could be months before the OR asks again and your OH income is sorted out. Your expenditure is likely to change between now and then anyway due to price rises etc, and you have plenty of time to organise one when asked (several weeks) and can be done here anyway!
You have other things to worry about right now. And glad OH is getting on well with work and his illness.0 -

If an IPA is put in place "several months" after the BR date, does this affect any surplus from those "several months" ?
Is the bankruptee supposed to put it to one side, or is it a case of if it's gone, it's gone?
Getting worried again........

SA - no. Dont worry. An IPA is only applicable from the date its set. There is no "surplus" before that as it hasn't been worked out. You need to put nothing by.
You DO need to put the money by if the IPA has been worked out but not yet collected. This is the same for the nil tax code - do not put it by before the tax code is nil, but you must after. Sometime it can take a short while between organising things and actual collection.
And to keep things together, as mentioned, an IPA can only be put in place BEFORE you are discharged.0 -
Hi Queen. Thats great news that OH is working - its hard to go back after so long. I wish him well and hopes he keeps his medical condition under control.
As skylight says there will be an opportunity to put together a new I&E when necessary. As he is working now some of the amounts (travel for one) will have changed since original one.
