HELP! (Mortgages & charging orders)

Hi

I've posted on here before about my lovely happy relationship with the vile bunch at egg. I thought it was all dealt with, but no!

Our fixed rate expired on our mortgage at the end of December. The payment amount has shot up from £618 p/m to £956 p/m

We are paying Egg £82 (plus they have a charge on the property) and the CCCS £209 for all the rest.

We spoke to our mortgage lender (GE Money, who I dearly would loved to have dumped but are the only ones who give a half-decent interest rate to anyone with a CCJ) who said fine and gave us details of a mortgage with a repayment of £780 ish a month. Still not fantastic, but much better.

Now it emerges that we cannot simply switch our mortgage to a better a deal, as Egg can force us to include their loan amount. The lady at GE spoke to Egg's solicitors who, true to form, were not prepared to budge.

So it seems we now have a choice of paying £956 per month for our mortgage, or being forced to borrow more to pay off egg when we can't afford that option either?

What on earth do we do? This is not even considering the impact on our available income to give to creditors via the cccs, which a rough calculation reveals to be approxmiately buggerall.

Every time I think we've got things sorted, the egg loan pops up again and we end up in a worse position than before, and our ability to pay anyone anything is diminished.

It makes me wonder why I bother with life at all, to be honest.

First thing id say is that no matter how bad it gets theres always a way out of things

In honesty egg arent making it easier, but there should be some negotiations you can to to sort this, or try other companies to make up the shortfall

The only other thing i can suggest is to post you income/outgoings for us to see if we can help you cut other costs to help pay towards the debt

Are you talking about starting a new deal with the same company? Certainly if you try to switch providers then there are problems with the priority of charges on the property and egg would be within their rights to refuse. If you are trying to refix the same mortgage it should be ok. Can you clarify the exact deal you have a problem with?
