catch 22

hi all
just when you thing it cant get any worse!
our landlord has now deciced they will not extend there lease due to the fact we are going bankrupt!
So now the problem we cant have our deposit back for six weeks after we leave and of course we dont have £1200 to use for a deposit from anywere else!Plus we need a guarnator again that we dont have just elderly parents who thet wont accept!
Have spoken to my local council who are saying thet wont help because its my fault we are being made homeless!
Any one have any advice at all Please??

    Hi Paul,
    I am in Kent too. Sorry to hear of your situation. I work in Local Government though not in Kent. But I think you would be entitled to temporary accomodation, I would suggest talking to the Homeless Person's Unit at the council and also visiting the Citizens advice bureo.

    I would suggest that you talk to your landlord and explain that because you are going bankrupt, does not affect him. I would have thought that in reality it means you are not under pressure from other creditors anymore, so paying the rent is a doddle. Or did you by any chance at any time fall behind in rent?

    If the property is empty for a period of time, landlord gets zero, if you stay he's taking less of a risk.
    A case of beer has 24 cans. There are 24 hours in a day...............Coincidence?

    no rent always paid month in advance so they wont have a problem there being just stupid surley its better to have it rented to someone who treats the place well?the owners husband died last year so the house is all payed for i would have thought as an investment and rent coming in it would be a good idea for her?
    They insist rent is paid by standing order and as i cant do that on the 1st march as my new account wont be up and running thats the exscuse there using!! even though i can pay them cash!

    I remember you mentioning that your wife may use her dad's account for a bit, any chance you could set up a standing order through his account, and pay him cash for the rent for a few months?

    Working in the debt advisory area, as I do, this is one of the areas we have to check for when clients consider going bankrupt. A lot of private landlords actually put it in to the tenacy agreement and they will evict you.

    With regards to your housing problem, you need a letter from you current landlord to say that your tenancy is not being renewed as of a certain date. You will then have to approach the local housing authority to declare that you will be homeless from that date. You can also do the same with any housing associations in your area.

    Do you have any children, if so, mention that they would be considered to be vulnerable.
    I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!

    hi again we checked our paperwork and there is no mention of being to throw us out if we are bankrupt only if we cant pay the rent!
    as for father in law i had to beg and i mean beg him to allow her wages to be paid in for one month no way would he go for our rent being paid through his account even if we give him cash his dislike of me is even more than i thought So sad it has to be like this his son borrowed £100k from him last year he took out a loan on his house i know its not my bussiness but he is a millionaire!!

    Sorry to hear on this on top of the other things :grouphug:

    If you are going BR on 13/2 surely you should have a new Bank account opened for 1/3 - I know that we still have the same bank account as before we declared BR but then that is just a Basic Account. Is you bank account a Basic account just now - you can open a Basic account on the sameday as BR or if your Bank freezes your existing account the OR can phone them and let them know it is okay for this to run (I do realise that the bank does have the final option of keeping the account open or not but if it is a Basic one then I would imagine there would be no probs)

    As others have said most landlords should be okay if they are receiving their payments - I would approach them again stating that there is nothing in your tenancy agreement and that payment will be made for 1/3

    HI Paul, sorry to hear of your troubles. Am new so please excuse any mistakes(have been an avid site visitor since April 05 but too stupid to register correctly till DH took pity on me!) Shelter have an excellent helpline that is staffed by experts 24 hours a day 7days a week. They may be able to give you specialist help. I don't have the number to hand but its in all the phone books. Hope this helps in some small way. Good luck and tons of love.

  • I think I have picked up on previous threads that you are a family man. Children 10 and 12?

    To to the Citizens Advice Bureau and find out what rights you have to housing. I think that if it is not in the terms of your lease that you will be made homeless by br then you may have a case to be housed as your lease has expired and you did not know that it would not be automatically renewed. This could very well be temporary housing in B&B while it is sorted out but I think that you cannot be assumed to be intentionally homeless if your lease does not bar you from becoming bankrupt.

    I personally think your landlord is being very short sighted but hey you can't always reason with people and their prejidices. (sure that is not the right spelling).

    You are already going through Hell, Try one of your local housing associations lots of them are connected to churches they may be able to help. Do a google search for crisis housing.

    My heart goes out to you as I now know that BR is going to be my lot as well and I am just beginning to put together the paperwork and get a court date prob in march.
