help needed

i need some advice please.i bought my daughter a laptop from argos 4 xmas ,weve tried setting it up but it wont let you do anything as its asking for a password. OH is convinced its a return as there shouldnt be a password already set. also, there is a few booklets in the box but no actual instruction manual. wher do we stand at returning this, bearing in mind we bought it back in august (im really organised )

    Ask on nTechie Forum - give the FULL details of the laptop, make model number & as much precise info, that it's displaying/asking for, to make it work.

    If you give your post a heading. like... Toshiba Laptop -How to set it up.. you'll soon have some cleverer than me, Moneysavers let you know if it's already been used, or if it just needs setting for your D's preferences.

    Then you'll know if you've a journey back to the store, tomorrow!!

    thanks for reply vans but OH is very techie and has tried everything to get round the password and its just impossible,which is why hes saying its already been set up by someone else beforehand. im just really bothered incase argos tell me i will av to go direct thro manufacturer.daughter will be gutted if she has to wait weeks for it. shes already gutted as it is, shes only 10 :confused:

    Unfortunately this is the risk you take if you buy Christmas presents in August.

    Even though you have only opened it today, your receipt will show that you've had it for 4 months, so it will more than likely get sent off to be repaired, but repair turnaround is usually quite fast, it will be slow until after New Year because of Christmas and New Year but after it should only be a maximum of 16 working days.

    PPS Argos will send it off for repair.

    I think these replies have taken this topic away from the point that you may have been sold a return without being duly informed.

    I'm not sure too much about the law, but my understanding is if it's a return then you need to know it is in advance and they are usually sold at a discount.

    I know it's been 4 months but everytime you buy a pc/laptop there will be a serial number for both the laptop itself and the windows package. I think it should be traceable.

    Take it back to Argos ASAP, explain your situation and if they are being unhelpful and you are stuck at a dead end then contact Trading Standards as I've never heard of a brand new computer already set with a password!!! (and demand a replacement laptop too and not a repair as you have consumer rights!)

    Unfortunatly that's the extent of the advice I can give you as I know no more.:confused:

    Certainly if you have been sold a used/second hand/ex display etc etc, then you HAVE NOT got what you paid for.

    Therefore, as long as you've still got reciept to show it was supposed to be 'new', (not totally required, but certainly help save getting them to check their systems), the fact you bought it in August shouldn't be a problem in terms of Sale Of Goods Act. There isn't a cast iron time scale as to when - or when isn't - a reasonable time scale, to bring it to their attention. The store offers 28days IN ADDITION to your staturatory rightrs.

    It is THEY that have sold you an item, that wasn't as described. Stand your ground & do your best NOT to accept a repair.

    Again, if you do post in Techie Forum, there might be someone that will tell you how to work out how many hours use, it's already had. Then there is more evbidence available, that it was previously used. This information & usgae could be back tracked, no doubt, with some software program, which you wouldn't be expected to have access to.

    If Argos argued, then they would need to cover the costs, this investigative work would incur.

    Don't think they'd even start on that route, as it would prove them to have been selling mis-described merchandise!

    Laptop computers are excluded from the Argos 30-day money back guarantee, so it SHOULDN'T have been accepted as a general return, although it is not entirely ruled out, sounds perhaps like a system fault, if it's Windows Vista, there will be interesting times ahead!

    It is as described but it is a system fault which can be resolved quickly.

    i know they are excluded from the 30 day money back garantee but nothing is excluded if they are faulty surely. so my reckoning is that someone has took it back saying its faulty and its just been put back in the stock . im off there in a short while,hope its open. daughters getting all excited now, hope they dont let her down.

    Very possibly but that doesn't explain the lack of an instruction manual which is one of the suspicions this issue was raised on in the first place.
