Capquest - "Letter Before Action"

for a standard letter like this you don't need to sign it. just type your name.
if you visit some debt websites you will see they recommend not to sign name for standard letters,
but not for letters such as subject access request which is not really needed here. I have read hundreds of debt sites and forums recommended never to give a debt agency a copy of your signature if possible and I see that as good advice.
A genuine question: is that because the debtor is trying to wriggle out of paying and doesn't want his/her signature matched to the original loan agreement?
If so, I suspect this thread needs locking because that would be obtaining pecuniary advantage by deception? You'll always miss 100% of the shots you don't take - Wayne Gretzky
Any advice that you receive from me is worth exactly what you paid for it. Not a penny more or a penny less.0 -
Hi,
I don't post very often but thought I would here.
I had a similar letter from them yesterday for a debt to egg for 2.5k that had been passed around the houses and then to capquest. I rang them when normally i would have only contacted them by post, purely because I know me and I know i'd worry about it all over the holidays and I didn't want that. SO I built my self up and rang, I don't actually have any money in my bank account until I get paid so they couldn't have anything off me....so I rang and got the most laid back bloke, he was fairly friendly considering and set up a payment plan of £10 a month, there was no trying to get me higher which I was sure there would be he just asked what I could afford and I said 10, they're sending out the DD forms so I've got a bit of extra time and I wanted to double check the debt had been passed back to them (it was originally with them and I had a copy of the thing from egg saying it was being passed on). Within 5 mins it was all sorted and I felt so relieved.
I'm not saying they're like that with everyone as i have heard some horror stories about them. But they were much nicer than the horrors that are first credit or what ever they are.
If you do ring, agree something you can afford if you start to feel pressured just hang up.....and don't give them your phone number, they didn't even ask for mine.
good luck and try not to worry too much!!!
Dxxx
Thanks for that!
I've emailed them saying I have tried to make contact, and I am still considering phoning them again tomorrow, like you said I don't want to spend Christmas worrying about this and waiting for bailiffs to appear at the door!0 -
What ever you do please DON'T do direct debit, they can take what they want.0

I don't believe anyone should 'wiggle out of paying' and would never suggest that ever. if you read my post I was recommending offering an amount they can afford and a reasonable amount as well, certainly no suggestions of not paying was mentioned at all.
unfortunately there are many tales of fraud, identity theft etc and I agree with the opinion that as little personal details are passed to any company whether debt agency or not if it is not required.0 -
Thanks for that!

real bailiffs with proper authority will not turn up at your door just like that without a court order.
they are talkong about in house collectors who have no authority what so ever.0 -
So how soon can these 'in house collectors' show up? Can I still avoid this happening?
Sorry for the daft questions, not really clued up on this kind of thing.0 -
I know I'm probably over reacting but I guess that's normal? I'm a bit of a worrier anyway... I've just got visions of bailiffs showing up on Xmas day!!
That is on the list of things which won't be happening. Bailiffs need a court order to exist and to be passed to them for action before they can do anything, in all cases except property rental, if I remember rightly.
You seem like a smart person so despite putting your head in the sand as you say, I think you'd have noticed being taken to court.
They might send debt collectors round (but not on Christmas day) but you can safely tell those nonentities where to go, or totally ignore them if you prefer, and phone the police to complain about them trespassing if they don't get off your property. If you don't stand for something, you'll fall for anything0 -
Thank you everyone, feeling a bit more reassured now. I'm off to work soon (hence being online at this ungodly hour!!) and think I will call them during my break; I'll feel a lot better when I have spoken to someone. Hopefully they'll let me arrange to pay off the money as of next week when I get paid.
I live at home with the parents and they don't know about this so really don't want debt collectors showing up, especially as they're at home more than I am.0 -
Capquest must be busy at the moment - picking Xmas as the time to post! Have an agreement with them and they have just had H L Legal send out one of their solicitors letters - I know this will be because we haven't returned the DD form they randomly posted out this month with an increased payment on it. (only been with them for 3 months)
You only have to google them to piece together their processes. I will be responding to both in the 1st class post on the first posting day after Xmas stating I did not want my letter lost in the Xmas post with my usual cheque.
