anyone had dealings with mercers

Anyone had dealings with a place called mercers from liverpool.My partners just had a call from them at 8pm tonight.She got her first letter of them on saturday morning,and by 11am saturday they rang up left a message.Anyway they rang tonight and were nasty on the phone to her,told her she should get a full time job instead of a part time job.Can these people speak to you like this?.They asked for a payment off £20 a month but the letter we sent barclay card had all our creditors on and lists off what we've offered each one and there's was £6 but because we said no to the £20 they wanted they now said that this will be passed onto the baliffs.What can we do now things are just getting worst for us now

no they cant!! first of all get her to send a letter to them stating that from now on ALL correspondence to her must be done in writing and any further contact via telephone will be classed as harressment and should they continue that you will be keeping a diary of all contacts and will be speaking to the OFt
Are you going through the CCCS or something with your debt management plan or have you presented the financial statement of affairs to all your creditors off your own back?
And it doesnt just work that they can 'call in the bailiffs', they are trying to scare you.
im with the cccs and was told that they can only resort to the bailiffs if you fail to stick to a CCJ where a payment has been agreed by the judge ...
they are all nasty little bullies who deserve to be stamped on!!:EasterBun ...what more do I need to say?!

oh yeah and i forgot to say make sure she sends that letter by SPECIAL delivery NOT recorded ,.,.,,, you will be astounded and amazed at how much mail they reckon they never get, especially ones that prevent them from contacting you / her on the telephone and once they have got that letter they are breaking the law if they then continue to do so.:EasterBun ...what more do I need to say?!

Mercer are PART of Barclaycard, their in-house debt collection wing. And they're telling lies, they have to go through a long court process before bailiffs are involved.
Send them a copy of the following letter, should make them write to you:Dear Sir,
Ref. XXXXX
Despite my letters regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue.
This behaviour constitutes harassment; the letters stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.
Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to your local Trading Standards office. For your information note that ALL telephone calls are taped.
COMMUNICATE IN WRITING – THIS MEANS NO TELEPHONE CALLS, THEY WILL NOT BE ANSWERED, YOUR ‘OPERATIVES’ WILL NOT BE SPOKEN TO. HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

Thanks for the reply,i've been in contact with specrem ect but they wanted stupid money before they even started to help us.After reading on this forum i got in touch with cccs but they couldn't fit me in for 2 weeks so i tried to sort the problem out myself by using a form of figgures that all finace sent to me what they'd use to pay each one of.But out of about 15 different creditors only capitalone excepted both of our offers,the rest just said no.The funniest one was the halifax they turned it down because i pay to much gas !!!!!!,what can i do there prioty debts.Anyway got my interview with cccs which lasted for a hour and at the end they said we don't have enough income left over for them to help us.So they did advise me to apply to the bristish gas engergy trust fund for help with the arrears on the gas/electric and also we can apply for help with the debts for our water and rent.If they except this and pay these debts off for us cccs will then be able to help us out.Now at the calculations of the cccs we would be paying less to each creditors than we offered has they added more money on to things like shopping ect has we were below the weekly average.So really it all depends on this trust fund whether or not cccs can help us out.I did ring the lady who was dealing with me about 3 weeks ago but they've never rang me back when i left a message
.I'll give her another bell in the morning and hopefully i can speak with her and ask for some advice.With it been xmas this has slowed the trust fund down,i'm praying i hear from them this week tho.I'd declare myself bankrupt but is it worth it has most of the debts in my partners name and she won't do it.

Been on the phone to them has at 8-44 this morning they were on the phone once again leaving messages.I've lodged a complaint about the caller last night and our accounts have been put on hold for 2 weeks so no more calls from them.Hopefully in this time i can find a job and we can start paying things again and get out of this mess0

Ok we've tried dealing with mercers but had no joy,i was in asda's before and got a call on my mobile from a firm called rma about my barcleycard account.I've never ever had someone like i had talking to me on the phone in the manner he did.He asked me if i was working and i said no,he then asked if i wanted a job i said yes.This is all after telling him that i tried to make a payment to mercers but they wouldn't except it so i said to him it's either except my offer or i go bankrupt and you end up with nowt.I was then informed that i wouldn't get a job if i go bankrupt has employers now run a credit check on you to make sure your trustworthy !!!!!! is this guy on why would employers run a credit check on you.In the end i laughed at him and said look i'm in the middle of asda's shopping it's not the right time and he still argued with me.In the end i hung up on him,there was no way i was talking my problems over in the middle of asda's and be spoken to in the manner what he did0

I am ashamed to say that when I offered to pay Mercers something on the 25th and they said no it had to be the 18th I said sorry no can do. They caught me at a really bad moment and I actually said if you can't wait 7 days there is nothing I can do I may as well top myself. When the woman on the end of the phone said I couldn't put that level of stress on to her i said yes I can, you are driving me to it. easy solution - when they call refuse to speak with them or tell them they have the wrong number when you ask them who is calling. You have no obligation to speak to these muppets, all they will do is try and bully you into submission.
You have requested that all correspondance is in writing and that is sufficient.
They cannot threaten you with Bailiff, a bailiff cannot legally visit you until the debt has been through the county court.
If they take you to county court all they will get is what you tell the judge you can afford.
They are chancing it and unfortunately sometimes it works. People panic and cough up what they can't afford to. At the end of the day they are running a business and trying to get the cash back as quickly as possible. Doesn't mean they can threaten you. The ball is in your court and the control is yours. Take it back and learn your rights.

i agree ive been there and come through the other end there threats are hollow crap if the dca have not bought your debt refuse to deal with them they and the people who work for them are immoral low life scum bags who will say anything to get you to hand over your last dime they would take the food out of a babys mouth . i went through the cccs then went it alone and servived and payed my debts all this rubbish about bailiffs etc if it aint gone to court they cant do nowt, dispute then they by lawthe dca should not be harrassing you, if the phone calls become irratating change your number simple as that if a dca turns up on your doorstep say you dispute the debt and will not pay untill a judge orders you too if he wont go away escourt him or her away there usually muppets doing it for pin money etc. as my solicitor said when they give you the money etc they no theres a risk of unemployment etc so tough luck on them the chairman of barclays isnt bothered if you hand over your last dime and go hungury so offer what you can afford and stick to it up it when you can, basically if it is unsecured KISS MY A, but as i say dont deal with dca deal direct with creditors if it has not been sold to a dca0

About 10 yrs ago Ihad defaulted on a Barclays loan and I got a phonr call from Mercers telling me that I should not have a pension policy as I could use that money to pay them.. They also told me me that I should not pay the endowment (that I had at the time) an pay them instead.
I called them back next day, got the supervisor's name and wrote a letter that I will not be told what I should or shouldn't do as I haven't refused to pay them. I also enclosed my statement of affiars offering them something. They apologised, I was told that the person in question had been reprimanded and my payment had been accepted. After that I had no trouble with them.
I think they are using bully tactics and are trying to scare - and unnily it works when we feel vulnerable. Just be firm and professional with them.
