This is probably a hard question to answer but...(re car agreements)...

I voluntarily returned a car I had on a personal lease plan just prior to going bankrupt (which I officially entered on Dec 1st) and today I've received an invoice for excessive wear and tear for £800. Some of the charges are fatuous; they're charging me for a a missing service book and spare key, which they have, but I could sort that.

My question is, will this charge be included in my bankruptcy or, because the specific invoice is dated post bankruptcy, will I be liable for it? My hope is because the debt was technically incurred prior to my bankruptcy, it will just be included, but does anyone else have a view?

Ho ho ho etc etc.

    Tempted to send the invoice to your OR and ask them to add to list of creditors.

    I'd argue (same argument I'm having over invoices and VAT Change!) is that the date of supply rather than invoice date is important.

    Got to be worth a try and see if OR agrees.

    On a side note, the cost of a new key for my vauxhall is about £150 plus another £60 for a dealer to programme it to my car.
    £210!!!! Shocking...

    Needless to say I am on the right forum so I know what bits to get from ebay and where to get the programming done much cheaper - but it's still £30 - £40.

    I agree with JCS1 - as you returned the car prior to BR the invoice should be included in your BR. I'd phone the OR's office and check it over with them to be sure. And send the invoice to them, but keep a copy for your records.

    I certainly can't think logically how I have run-up any of the debt since going bankrupt, so let's hope my OR agrees!

    Surely if the car was given up for vol repo before BR the invoice should be made payable to your OR ;)
