Endowment complaint - Legal expenses Insurance

Has anyone ever used this kind of insurance for solicitors fees when issuing court proceedings for the misselling of an endowment complaint?.

On the policy all it says is that you must notify them within 180 days of becoming aware of a dispute. However despite this being done, the company who offer the legal expenses insurance say that they look at the date when the policy was purchased (which they call the date of the incident). So as it was in 1993 they say the dispute is not covered unless you had legal expenses insurance back in 1993. How ridiculous is this?. Why even bother having legal expenses insurance?.

I would have thought the date of the first red letter would be the date of the incident.

I'm sure many people would have always had legal insurance with the house insurance. The problem would be that whenever you move house insurance (often in the case of MSAs?) you would move legal insurance.

Someone asked this a few days ago.

Legal proceedings as an endowment mis-selling complaint is almost doomed to fail. Unlike the complaints proceedure which requires the advising company to prove it wasnt mis-sold, the legal system requires the policyholder to prove it was. What documentary evidence could you supply to prove you were mis-sold?
