can you go against advice from cab

hi

ive got an appointment feb with a debt advisor from cab ( this is earliest they can fit me in) I intend to go bankrupt but if they dont actually advise me to go bankrupt can i still go ahead or will the OR refuse it.
I know i cannot afford to pay my debts and im worried they will just advise me to make token payments of a few pounds which would go on for years.

  • It totally depends on the details of your case. They will look at any assets you might lose, your income and expenditure, etc. If you disagree with the advice from the CAB, you can get alternative advice from CCCS or National Debtline, but you would need to be fully informed of the repercussions of going BR.

    Doesn't CCCS have an online quiz you can do for a quick analysis of how serious things are? Have a look at their website, Choccy. It doesn't take the place of a full advice session on the telephone but it may help you assess whether bankruptcy is advisable. February is a long time to wait for an appointment, though Merry is absolutely right that you should get as much advice as possible, from as many sources as possible.
  • ok thanks i was advised by payplan a couple of years ago that br is best option.didnt go ahead as too scared so buried my head.situation worse now so cant avoid it anymore.

  • Yes you can. We went against CCCS advice when they refused to help us with a DMP as they said we were bankrupt. If we had listened we would have lost our home and been much worse off than we are now.

    Hi cc - the 'advice' given by CAB, or NDL and CCCS, is just that - 'advice'.

    The ultimate choice as to exactly how you wish to deal with your situation will be, quite rightly, yours and yours alone.

    The reason that we, on this forum, reccomend that posters talk to the Debt Counselling Charities is that they employ professional advisers, who have seen many people in the same position as yourself. They know the various options that are available and will only advise what they think is the best solution for your individual circumstances, but nobody is going to hold a gun to your head and say 'You must follow any particular course of action'.

    If you have concerns about any option that CAB might suggest, then you should always voice those concerns and ask what the alternatives are.

    There will always be alternatives and you have the right to choose the option that you are happiest with.

    We, and the Debt Charities, fully respect your right to choose which solution you adopt and, as a forum, whether DFW or Bankruptcy Board, we will try and offer you support based on our own experiences.

    The judge may ask if you sought advice, not if you agreed with that advice, and not all judges ask.

    before i went BR, CCCS refused to help me as i didin't have enough spare income and told them don't go BR u don't earn enough it will do you any good in long term! I though waht a really axs advice from them lol )

    i went to National debtline they were brillaint, they help me to draw an Icome and expenditure ( i was useless with managing money) and from then they advised BR , the CAB also advised to go BR as it has given me a fresh start ...
