Advice On Refund Policy Please

Hiya all

I bought a watch in august this year online from a store in newcastle 115.00
it is a plastic fashion watch.

After only a few wears it fell off my wrist as the strap came away from the face.

i've taken it to be fixed several times at a couple of quid a go as it has happened a few times. i noticed the bracelet has a little crack in it which is why it keeps coming away, I guess this has happened when it has fallen off to the floor?

I love the watch but am scared to wear it as the strap is so fragile, it is lightweight plastic links but a big quite heavy face.

I've decided it is not fit for purpose and hasn't lasted a reasonable time and have returned it special delivery to the store for a refund explaining all of the above.

The store manager has offered a replacement watch but will not refund. the reasons he gives are
I've had it since august.
The strap is cracked which is why it keeps coming apart, I must have damaged it it would not just fall off (how can he be sure, it DID fall off and is now damaged from falling to the floor)

I've googled the brand and it is a high fashion item but notorious for the bracelet strap breaking.
Bloomingdales have stopped selling them because of the problems in returns.

I've asked the manager to write to me detailing his reasons for refusing to refund.

I wish to take it further and seek a refund.
I paid with a credit card.

What shall I do next, who to contact.?

    I dare say I will be wrong, but after that length of time I think they are only obliged to offer a repair / replacement.

    If I were you then i'd accept the replacement.

    Not quite sure why it "fell off your wrist" - was that because it was broken at the time or through your fault?
  • It is guaranteed for a year.
    it came off initially because the face is heavy and the strap very fragile
    even putting hand into pocket or sleeve or handbag would pull the bracelet apart.
    It is basically not fit for its purpose.

    I've contacted the credit card company who have been very helpful and filled in a dispute form.
    They advised me that the retailer cannot refuse a refund while it is under garantee

    I was given a watch as a present, with numerous sparkly stones in it. Which are always falling out!! Luckily insurance was bought too, I have had 4 replacement watches! But everytime I have to renew the insurance which is about £8.99 a tim, worth it in the long run, but I'd rather have the £120 back instead of numerous replacement watches.
