'Help Needed Wage Drop'

Hi, I am seeking advice and any comments will be helpful.
I have worked for a restaurant, part time since I was 16 for the last three years, I left in October 2008 to go to university, with the intention of working there when I come back over the christmass period.
I have been told, I will now be paid less 4.77 I think, as I have been taken off the books, and all the new starters are paid 4.77. This has annoyed me as I was getting paid 5.73 and I will now be paid less.
Can they do this to me legally?
What should I do, I feel they are pulling a fast one over on me?

If you're a casual employee, i.e. you have no employment contract with them, then I believe they're acting within their rights (and complying with national minimum wage). Of course, as a casual employee, you are free to work elsewhere...

Yes they can. Your original contract ended when you left in October. You are now on a new contract. You are being paid the minimum they can legally pay you.0
