CCA Question

So finaly DCA got back to me 11 days after they got the 12+2 :rolleyes:

has the normal talk please phone us wiithin 7 days ETC. but has the following line. which is in relation to the CCA request.

"we must now inform you that we are unable to comply with your request due to not having the required information to do so"

and they need more info from me to be able to get it.

:confused:

lost as to what to write next to them.

i did notice that they keeped the £1 for the CCA request i sent mind:rotfl:

any advice??

dont mind paying them back just want to be in the driver seat

    I've never done this myself but maybe write them a letter saying something along the lines that if they don't supply the required information they cannot chase you for the debt and you will no longer be dealing with them in relation to the debt.

    You need, as stated, do nothing - the dca has breached the terms of the Consumer Credit Act, by not sending your cca within the legally prescribed 12 working day period, and, even if he magically finds it now he must seek permission from the Courts in order to 'enforce' it.

    Whatever you decide to do, you are now in the driving seat, and the dca is 'in default'.

    Do not give them any further information - they were happy enough that they were 'dealing with the right person' before your cca request - what can have 'changed' now? :confused:

    I don't, in all honesty, think it a good idea (nice thought though) to request that they refund the £1 statutory fee.

    Keep copies of all letters, though, in case this dca passes the 'debt' on to another dca, in the future, contray to the Data Protection Act.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    Not even £12 p/m late fees and Intrest at 29.8% untill i get the pound back or the CCA at least :o .. :rotfl:
