scared to take a greivance against employer

Hi all, I am really unsure of what to do. My situation is that I work for the NHS in a hospital part time as a secretary and I have been there for over 3 years. I am on a band 4 (which was a A&C 3 when I applied) and came from an NHS job which was a A&C 2 (went up to a band 3 as I left). I was put on a preassimilation band when the A&C 3 went up to a band 4 but I was placed 2 points below the band 4. At first I never questioned it as AOC was new to me. After a while and a bit of digging I found out that another employee who started the same job, one month before, was actually on a proper band 4. The problem I have now is I have found out that this was due to me starting on 3rd oct 2005 I missed the protected band 4 rate by 3 days. If I had started with my colleague I would have been on a fixed band 4 but as I had to give my previous employer a months notice I had to start in the october.

Sorry if it is confusing but I have been sat on this for 3 years. I have approached my employer whos HR dept told me about the dates but my beef is I was offered the job prior to 3rd oct 05 so why could they have not protected my wage to a band 4. This has been a dead end as they continue to stick to protocol and wont back down. In total they probably owe me around £3000 if they have put me on the wrong payscale.

Has this happened to anyone else? I feel like I am banging my head on a brick wall and have even emailed the NHS payscales people who have not contacted me from over a month ago!!! Grr so annoying. Help!

    Employers can re-evaluate the job and lower the grade, they must however provide protection at the existing grade for people who have been there for 2(?) years.

    The date is from the start of your contract.

    You need to seek support from your union rep with this one as a request to rematch must be made within three months of the original matching panels decision. You must then provide written details of why you disagree with the outcome - as you can see your situation is unlikely to be resolved by requesting a review.

    My advice would be to contact you branch secretary for advice and support as i can foresee some considerable difficulty.
