Hi all - wonder if anyone can help with information?
I have/had a credit card debt with Lloyds TSB. They wrote to me advising that if I did not pay £140.00 by a certain date, they may pass my debt on to a third party for collection.
I paid the £140.00 before the due date & spoke to Lloyds TSB to try to come to an arrangement. (I have had arrangements before & broken them for financial reasons) I filled in an income/expediture form & returned it to them as requested. I have had no response from this what so ever. The only thing I have received was a statement requesting a rather larger the usual payment request & a note on it saying that if I did not pay by a certain date, they may take legal action against me.
The first week in December, I received a Telogram letter to which I have not responded. I strongly suspect that Lloyds TSB have sold the debt as I have not received another statement nor any phone calls from their call center.Telograph have started fishing around on the phone but have not yet spoken to me - I have read the storys of what to do on here but my question is the following:
Can Lloyds TSB legally sell the debt without advising me that they are going to do so first?
How do I stand that I felt that I was in communication with them before they sold the debt?

Hiya
I am not an expert but.... to my knowledge you have to default on the payments and/or arrangement first.
You say that arrangements have broken down in the past. Were you sent a default notice then? This would be a document/letter that very clearly states that your account is in default.
Also, maybe experts could jump in here, LTSB would have to have sent you a notice of assignment if they had 'sold' the debt on.

I was sent a default notice & given so long to pay £140.00 which I did before the due date. I then spoke to LLoyds TSB when I made the payment and told them I wanted to set up a new arrangement for which they sent the income/expenditure form which I returned with an offer to pay £80.00 per month. Heard nothing since, only had one statement since then as detailed in my original post.0

I certainly haven't had a notice of assignment from LTSB but worryingly, I haven't received any further statements from them either.0

It sounds like they have sold the debt on.
Do not deal with the people who contact you over the phone!
Keep a strict diary of contacts made by you and them, letters, attempted telephone contacts etc - what was said, date, time and who you spoke to.

Telogram are actually Capquest in disguise (A DCA and a bunch of scumbags in my humble opinion). I've had dealings with them in the past, first they claim to be this organisation called Telogram to try to get you to call them.
If that doesn't work they'll next write to you in their true colours as Capquest.
As has already been said, don't deal with them over the phone at all.

Thanx Linda - alreay set up an excel spread sheet to keep all the contact details on. This is the only debt I am in arrears with - Have loan with my bank but not in arrears & payed by DD monthly. Have read all the sh#t on Telogram/Capquest - was not taken in by the Telogram letter thankfully, Checked on here & Google & uncovered some horror stories. Just trying to get to the bottom of if LTSB have acted improperly & hopefully make them either buy the debt back from Capquest or give me some compensation which may enable me to pay off the debt anyway.0

My elderly mother has just received one of these looking for her grandson. We haven't seen him for 10 years or more and haven't a clue where he lives. My sister has written to the company and told them not to send any more letters to mum, we are really annoyed that they can send this type of letter to anyone they think may have informatin about someone.
As I say, we haven't seen my nephew for years, after a family row, and he certainly wasn't one to keep in touch when we were speaking let alone now. I just hope that he hasn't used her home as an address to get credit or anything.
Luckily my mum is quite strong minded and my sister lives quite close but it could have really caused mental stress to someone who didn't have anyone to look out for them.
Have just seen Watchdog and it had a company called Ruthbridge which uses the same tactics as Capquest. Seems they are not an isolated case.0
