On the 19th December we sent CCA letters to Lowell in relation to my husbands Capital One Cards. (12+2 etters)
We also sent letters to Capital One to claim back the PPI and Charges which total more than the balances on the accounts.
On the 9th we sent the 2nd letter from this site telling Lowell to cease all collection activities.
We heard nothing from Lowell until today, letter follows
Following your recent request to be provided with a copy of the original credit agreement in respect of the Consumer Credit Act I can now confirm that our Client Capital One has requested that your credit agreement be retreived from their archive.
Once your agreement is retreived you will be required to repay the outstanding balance in full. If deemeed necessary, we may inititate legal proceedings which could eventually see your outstanding balance increase due to court costs and interest.
In an attempt to resolve this matter in an ammicable way I would like to offer you a settlement to bring this matter to a close.
As long as you pay us by the 11th December I am willing to accept £518 as full and final settlement on your account. If payment is not received within the time we reserve the right to proceed to collect the full outstanding balance.
The letters are dated 8th December.
What should we do next please.
We had a small offer from Capital One, in settlement but sent them the 2nd letters advising we would be taking them to court.
What should we do know with Lowell - wait until we get a response to the 2nd letter or should we send another letter in response to this one.

Do you think we should send the 2nd Lowell letter again advising that we have received thier letter dated the 8th?? and that they have gone past thier deadline to sent the proof?0

It sounds that they are panicking and trying to get at least something out of you as they have not got the cca on their records and if Capital One have not got it they are in trouble.0
