I'm sure there is someone on this site who can let you know some legal mumbo jumbo you can quote to them to stop them harrassing you. Its not on really!
    In debt no more!
  • you can write them a letter stating that you will only deal with them by letter

there is a good letter on this site somewhere

you are quite within your rights to do that
  • Try this one:
    Dear Sir,

    Ref. XXXXX

Despite my letters regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue.

This behaviour constitutes harassment; the letters stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.

Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to your local Trading Standards office. For your information note that ALL telephone calls are taped.

Take further note that continued telephone calls after the receipt of a request not to call constitutes a criminal offence under Section 127 of the Communications Act 2003.

COMMUNICATE IN WRITING – THIS MEANS NO TELEPHONE CALLS, THEY WILL NOT BE ANSWERED, YOUR ‘OPERATIVES’ WILL NOT BE SPOKEN TO. HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

I trust that I have made myself understood on this matter,

    Yours faithfully,

  • No, they tend not to believe people when they say they're going bankrupt. Just let the Official Receiver tell them afterwards.

this firm employ the rudest staff i have ever come across. Not only that tey discuss your business with other people. They call repeatedly to speak to my wife but last night they happily told me everything about her debt with capital one. Not that i didn't know already but they got a bit coy when i mentioned the data protection act to them and said they would call back.

dreadful firm which does nothing to enhance the reputation of capital one either

report them to the data protection act registar if they break the dpa, telling someone else about your debts is definitely against the dpa!!!

answering machine messages should be fairly vague too, certainly shouldnt say things like that on there!!
