sons debt at our address

not sure what we have done to deserve it but our son treats us like dirt
long story to one side, he has gone, somewhere, and left open a car insurance policy and phone contract with no money in his bank
both registered at our address
he is so selfish its untrue, all we have done is try to help him
i suspect the bank will charge him for the failed demands on his bank, will his bank let him go overdrawn?, he is already up to his £100 od limit
will we get baliffs around if he doesnt turn up and defaults, his bedroom and its contents were paid for by myself so effectively belong to me,
hate the way i sound as its like i dont care about him but after the way he acts all careing has gone.

Sorry I cannot offer much in the way of advice... Only to say someone much more knowledgeable will be along shortly.
I can however, Sympathise with you having some experience with a family member who acts in exactly in the same way...

All you can do with his post is return to sender, dont open it as its illegal to interfer with someones elses post, and by returning upopened the companies might realise he doesnt live with you. I think it might be worth a trip to the CAB, as they may be able to advise you in more detail. As if his debts go through to baliffs they will go by the last address they had.xx rip dad... we had our ups and downs but we’re always be family xx0

What a horrible situation.
The bailiff bit I can help with. It might, ultimately come to that, yes. But the debt is nothing to do with you and they have no power to enter your house and/or take your property or anything nasty like that. Any kind of court order that was ultimately raised over his debts would be for the individual, not a property.
My inclination would be to return all mail for him as "not known at this address" to start getting it through to your son's creditors that maybe, just maybe, he doesn't live there. Aside from anything else, if I may be so bold, returning stuff like that without bothering with reading it will save you having to stress about it.If you don't stand for something, you'll fall for anything0 -
If your son has left home and left items in his bedroom that you have paid for, I would seriously consider selling the items and putting the money into a savings account (or bank account of some description) and saving it for a rainy day.
That way if bailiffs did come round, your son owns nothing that they can take.0 -

A person commits an offence if, without reasonable excuse, he-
(a) intentionally delays or opens a postal packet in the course of its transmission by post, or
(b) intentionally opens a mail-bag.
A person commits an offence if, intending to act to a person's detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him.0 -
I am sorry to hear of the problems with your son.
Millions of people have gone overdrawn at their bank and with this severe recession this situation is going to be much worse. It is so very rare that the bank would take proceedings that will involve a bailiff.
For this to happen they would need to close his account and take proceedings by way of the County Court and obtain a County Court Judgement (you will see letters from the court arriving addressed to your son). Even if this were to happen....which is rare, then the case would be passed to a COUNTY COURT BAILIFF. This person is very different indeed from private bailiffs and most of them are extremely helpful as they are not motivated by the charging of fees as they are paid civil servants.0 -
Sorry to hear how your son is treating you. That must hurt more than the money. Hope you get it sorted -some good advice here.0
