1 Bad Report On File

Im hoping this is the right area of the site, i need some advice.
A few yrs ago i had 2 current accounts, both got into difficulty and i (foolishly) tried to forget about them.
What started as small debts, escalated through bank charges and resulted in me owing 200 on 1 account and 300 on the other. They are mostly made up of bank charges but i cant hold my breath for long enough to go into all that stuff with the courts and unfair bank charges etc.
The debts were passed to Capquest, i requested a signed credit agreement which they couldnt provide and sent the debt back to my bank. I requested the same from the bank over the phone a few weeks ago (12th working day today). They told me that they would try to get hold of the "opening forms" from when i opened the accounts.
They also added that they have written off the debt but its still on my report and will be until the 6 yrs is up (end of 2009)
They havent made any further contact but i dont know what to do. Im trying to get a mortgage and apart from this report, my history is fine!
One of the accounts was opened when i was under 18, but charges applied when i was over 18, does that help my case?

If they have told you that they have written off the debt ask for that in writing. You can then approach the credit file company and have them mark the debt as settled.
All credit will show on your files for 6 years. Good or bad. But the fact the debt is marked as settled will make your file look better.0 -
thanks for the reply.
i mentioned making a part settlement to "restore my good name" etc. still not acknowledging the debt but the bank said they would only mark it as a part settlement and still not settled. Wouldnt they do the same if the credit reference agency contacted them?

Sorry I think I have misunderstood you.
If they had told me the debt was written off then there would be no debt so therefore the debt is settled.
Someone with a hell of a lot more knowledge should come along soon and advise you better.0 -

Hi,
If you were going to make any offer towards that debt then you would admit that it is yours, also if you come to an agreement with your creditor for a reduced settlement amount then it would say on your credit file that the debt is "settled" but they would had in comments that the amount paid was not enough to cover the full balance outstanding. Always make sure that all communication is done in writing.

thanks for the reply. i made sure that i said in the phone call that i dont acknowledge any debt to them but was willing to make a payment just to get it off the report quickly.
Il call them now and try to get them to write to me saying its written off and failing that i'll start writing letters again.0
