Hi I wonder if anyone can help me
I've received a notice of issue of warrant of execution for a judgement that was not paid. It says that I need to pay the amount before 14th Dec or the payliff will call. It says the total to pay is £137.25 (including fees) and then the balance outstanding is £6548.18. So what does this mean? The Bailiffs office is only open from 9.00am - 10.00am each morning so i've not been able to speak to anybody today. Any help would be greatly appreciated.
Regards

Do you know what this is about?
If it is anything to do with bailiffs, read the website that Herbie21 operates www.bailiffadviceonline.co.uk
I think you need to pm Herbie21; the other useful OP is RobertoMoir
And speak to NDL or CCCS, numbers listed here http://www.moneysavingexpert.com/loans/debt-help-plan#help
i suspect you are going to need immediate help with the Notice and longer term help unpicking or amending the judgement. If you've have not made a mistake, you've made nothing0 -
The first thing I might ask is, was this expected or unexpected? Do you dispute the debt, do you understand where it came from, or are you 'simply' worried about what will happen?
This is warning that bailiffs will visit if you don't do anything, and IIRC this will be county court bailiffs handling this notice?
In the first instance, whether or not you understand what is going on, you need to contact the bailiffs and see what you can work out with them with regards to time to sort things out and (if appropriate) raise money for the debt. As RAS says, you have two issues, the short term prospect of their visit and the longer term issue of the overall debt they claim you owe.
They want an initial payment of £137.25 if you contact them now, and will probably be amicable to setting up an arrangement to pay the debt off over time. When I say "amicable", they will want to do things on their terms, which may not be compatible with the normal good advice for handling bailiffs. If you don't stand for something, you'll fall for anything0 -
See National Debtline factsheet here
You will need to fill in a N245 and lodge it with the court that issued the warrant (Suspend the warrant, vary the order, make an offer of payment). Keep a copy. If the bailiff arrives before the court has had time to consider your application, show him a copy. But do not grant access. This is important.
I am assuming that you accept that you owe this amount and have either neglected a forthwith order or defaulted on an instalment order.0 -
Without knowing a bit more info it is difficult to answer this as a lot depends on whether or not your received the writ in the first place or whether you had any grounds to defend the action.
If the above applies then you need to contact the County Court for an N244 to apply to have the CCJ set aside.
If there are no grounds to defend the action, and you agree to the debt then once again you need to contact the court and ask for an N245 Form. This is to apply to have the Warrant of Execution set aside and to offer to vary the payments so that you can afford to repay the debt at affordable monthly instalments.
If you go the route of the N244, the Judgement will be set-aside and the matter re-listed for hearing.
With the N245, the Judgement stays on your credit file for 6 years and the debt can be paid monthly.0
