barclaycard and cabot

hi guys

just had my equifax report, and just after a bit of guidance!

firstly, i had a barclaycard back in 2003, with a small limit of mid £200's, due to going off the rails a bit, i didnt make any payment to it sincemarch 2004, the account then defaulted in oct of that year. this shows on my report, BUT with a default of mid £600's. i moved house around the same time, and never heard anything else from them, so havent made a payment since!

now, also on my report is an entry from cabot showing the same default balance, BUT a current balance of £900ish, i have also never heard from cabot, and have definately not made a payment to them. they are showing the same default date!

can cabot do this, as i have never had an agreement to pay them so they are effectively putting another default on my report which is the barclays one??

any guidance would be gratefully recieved!

if i heard from them, i would happily pay the the amount owed, BUT i certainly am not going to go looking for them!

thanks in advance

The OC will have sold it on to Cabot ,and they have added interest and costs . It maybe best to keep head down and wait for the time barred to kick in , which is March 2010 I believe .

Oh but doing a credit check may have alerted carbot to your whereabouts !
  • does statute barred come from date of last payment, or date of default?

It's from the last time you acknowledged the debt in writing or by making a payment.

I don't suppose you're in Scotland by any chance?
Unless I say otherwise 'you' means the general you not you specifically.
  • no, good old GB, so 6 years from march then? cheers!
  • also if they do contact me, what are the chances of them having the original cca?
  • also, can 2 companies (i.e cabot and barclaycard) put a default on my record for the same debt?

Good old GB? Where's that then? :D

You may find there's an overlap whilst Barclaycard "remember" to remove their name from the default. They'll quite possibly need a nudge. :p

If Cabot DO get in touch, the chances of them having an enforcable agreement is about as likely as me being the only winner in the next European lottery jackpot rollover. ;)
Cabot can now kiss my DONKEY. Statute barred is enough of a result, but the actions of the CABOT FAN CLUB have cost them far more than the paltry sums they were chasing us for.

barclays last updated their bit in 2005??

so if they have no enforcable agreement, can i make them take it off my file??
