Is this what I think it is.....?

Hi

Some of you may remember previous posts that i have written about problems that i have had with my employers.

Im on holiday from work this week and I have just received a letter from them. I will copy the main points of the letter below. I'm not sure if this letter is regarding a dismissal or redundancy, can someone advise please.

"We would like to meet with you to consult the position of Assistant Manager, as you may be aware in the last 2 months of trading (office) has not managed to cover their running costs and is therefore now uneconomical for the forthcoming trading months.

Therefore you are required to attend a meeting on (date) at (office) to discuss this with (Manager and Sales Director).

You have the right to be accompanied blah blah blah........."

It doesnt mention the words redundancy or anything but got a horrible feeling that this is what it is.

Help please.

    Confirms my worst fears really, god knows what i'm going to do now, especially as I've been looking for alternative employment now for 3 months and not even had an interview.

  • Sorry to post again about this but i'm really worried, I'm a single parent so I need to be as prepared as possible should I be made redundant next week. I have no savings left and not sure how i will cope with no job!

    Is the normal way that I would be informed of redundancy? It just seeems so informal....the letter doesnt mention redundancy. Can they just make me redundant from next Wednesday? Do i get paid up until that day? Do I have to hand my company car back on that day? Sorry for all the questions but am worried as I work 40 miles away from home and I would need to arrange alternative transport to get home if i give car back on the day

    Hi there, sorry to hear this.

    This seems like the initial letter they would send you to inform you of potential redundancies. You will then probably receive a second letter telling you you are being made redundant. You will probably find there might be more than just you being interviewed.

    Can i ask how long you have worked for them and also is there anything in your contract re notice periods ie how much you need to give them and vice versa.

    I've worked for them for about 2 and a half years and the notice period is one month for both parties.

    can i ask what age you are and are your weekly gross earnings over £330. if under how much per week.

    Do you think they would want you to work your notice or pay you in lieu for it

  • Im 34 and yes I earn more than £330 gross.

    I'm not sure if they would make me work my notice, they are very short staffed but it's quiet over the Xmas period anyway and I have more holiday to take before the end of the year.

    The situation is more complicated as I had a period of time off in the Summer due to Stress caused by work. They took on a new member of staff during the time I was off as they thought I wouldnt return.....I did and now I think that they are struggling to pay both of us.

    We have similar job roles but different job titles. It may be me just being suspicious but I think that they have been looking for a way to get rid of me anyway.

    Well firstly

    if they give you notice and your not required to work then you are due 2 x 330.00 (not subject to tax) plus 4 weeks notice ie 4 x current basic wage plus any holidays due at your normal holiday rate. The notice and hols are taxable.

    If its the type of work you could do damage in ie computer etc involved you will probably find they want you leave as soon as.

    With regards to the company car, when i was made redundant they let me have the car for a week or two after i had finished to allow me to attend intervies etc but i think they would probably want that back when you finish up.

    Is there only the two of you working at present, if so you might find you will both be up for redundacy and hopefully you will be OK, Does the other person have car and same wages etc
  • No, there are currently 6 full time members of staff (one has handed in notice already and due to leave next week) and 3 part-timers.

    I doubt the other person is up for redundancy as he only started there about 2 weeks ago. He doesn't have a car and not sure about wages, got a feeling that he has a slightly higher basic salary but dont know for sure.
