Housing Benefit help that's difficult ?

Hello all, I have read some of the posts on here and it seems some of you know what you are talking about, I need some advice and don't know where to look for it? at present I am receiving DLA at the higher care rate, and Income support, and I live with my Daughter in-law after returning from Bulgaria, unfortunately she lives in a 2 bedroom house which means the sofa for me, the council are aware that I am living here and they adjusted my daughter in-laws HB accordingly,I have tried to find a property to rent, but no one seems to want to let a property to some one on DLA, however, my daughter in-law is in receipt of Income support and housing benefit for herself and my grandson, and she wouldn't have a problem moving to a 3 bedroom property, as she would use her existing estate agent who would happily let her another property, my question is if she were to rent a 3 bedroom property or in fact if I was able to how would it affect her benefit and mine ? and would it make more sense for either myself or my daughter in-law to rent a property, I know this is complicated to me but can anyone help me try to sort out whats best ?At present my daughter in-law's rent at this property is £475.00 pcm, and she receives £402.00 pcm, which is already a struggle to pay, so do you think that things would be even harder if she rented a 3 bedroom house in order for me to be able to have my own bedroom, or would it be better for me to claim the HB, I just don't know which would be the best way to go about this from a finnancial point of view

    Hi and welcome. Just to clafiry... the £402 a month your daughter in law receives, is this the housing benefit she receives, or the amount she has to pay each month? So she only pays £73 rent herself?

    I just read your post and didnt understand this part.

    Unfortunately I know nothing about housing benefit, but im sure there will be people with more knowledge around soon.

  • it is very unlikely that they will pay ypu housing benefit for this. when i was living with my sis for a short period, i applied for HB but was turned down as i was in a property owned by a relative. try checking out your local council's website for more accurate info tho.

  • As you are both on Income Support think about taking another larger property as joint tenants. You will both be entitled to Housing Benefit on your proportionate share of the rent(half each?). You will need to check the local housing allowance to see if it meets the rent. Your local council office must display the allowance and publish on their website. It is based on bedroom requirements.
  • The previous poster is correct - your daughter-in-law would be entitled to the Local Housing Allowance rate for a three bedroomed property if you all moved to a new property. However, there would still be a non-dependent deduction from her benefit entitlement on account of the fact you are living with her - this would be £7.40 per week.

    For this reason it might be better if you could get a joint tenancy - you would be entitled to the shared room rate of Local Housing Allowance whilst your daughter-in-law ('cos she has a child) would be entitled to the two bedroom rate (or her share of the rent plus £15 per week, whichever is the lower).

    Ironically, if you could get a property in your name and your daughter-in-law and grandchild lived with you, you would receive the local housing allowance rate for three bedrooms and there would be no non-dep deduction because you receive the care component of disability living allowance, although I acknowledge you might have difficulties getting a tenancy.

    As an aside, has your daughter-in-law looked into claiming carers allowance? Would bump up her Income Support by £27.75 per week.
