New job and not been paid

Hi,

I was recently made redundant from my job (end of October) and didn't receive any wages for that month. Coupled with the fact that I was still owed £3000 in overtime, my plans went completely out the window (the company went into liquidation). Firstly, is there anything I can do to try and get the money? Including wages and overtime, it's £5000!!

Secondly, I managed to find a new job within 2 days of being made redundant. My first wage packet was due at the end of November. It's now December 4th and I've still not been paid. My boss doesn't know when I will get paid. As soon as we receive some money from a client, he'll pay everyone.

Now, with being made redundant and not being paid on time, I'm amassing bank charges and returned direct debits. I currently owe abut £250 in bank charges since November 27th when I should have been paid. We have no money - literally, nothing at all.

To top it off, my wife was made redundant from her job at the end of September. She was on maternity leave at the time. Since then we've had to re-apply for her maternity pay, which hasn't come through yet. Also, she was due redundancy pay, which also hasn't come through. If it wasn't for our parents buying our baby milk and nappies, I dread to think what position we'd be in.

What can I do?

    Unfortunately your wages are "unsecured credit". The administrators of your company have a duty to pay secured creditors, such as banks, first - sometimes you will receive some of your money but if your company went under this is unlikely to be much. Unfortunately the lesson you may have learnt the hard way is not to "loan" your company £3000 of your time, although I appreciate that when a company is on the edge refusing extra hours can be difficult.

    Again, unsecured credit. If your company has so little liquidity it can't pay employees I'd start urgently seeking a new job - that's very close to no longer having enough money to intend to pay creditors which will mean they will go into administration.

    Claim hardship and ask your bank to freeze and repay charges. You can't afford them at a time like this.

    Do you have any contacts from previous jobs? If so, use them and push and push until you get offered a secure job - any time you think you are being too pushy remember you are doing it to provide for your family. In the current economic climate this is the only way you will get a secure job anywhere near your previous pay, as people are getting desperate and are applying for any job that comes up.

    In the meantime, consider seriously whether you will get paid in your current job. If not, consider asking for voluntary redundancy and use your time to get another job rather than working for free. Don't quit though - this will drastically reduce the benefits you can claim if things nosedive.

    In the meantime, cut back wherever possible. The Old Style board has loads of good ideas for making little money go further. If you have no money now then make sure you are checking where every penny is going - Freecycle anything you need for the baby, eBay anything you don't need. Good luck - I think it will be very tough but remember that things will get better - concentrate on surviving until then.
  • Grim news old son. Same thing has just happened to me. Company went bust owing me 5 weeks wages. It is a scandal.
    You should be able to get some of it back.
    Being the Govt and their low maximums though, it is a maximum of 8 weeks pay at £330 a week for owed wages.
    You are entitled to redundancy pay too if you have been there over two years £330 for each year non-taxable.
    Also, notice pay at £330 a week for each year you were there. Say you were there for six years - from the day of redundancy you will 'earn' £330 a week for six weeks. At the end of this period you claim it minus any benefits or earnings from a new job. Bit complicated
    The Red and wages you can claim now - the notice pay at the end of the lieu period. This money is from your NI contributions so you WILL get it, you just have to apply. There is a good booklet below:
