Holiday entitlement fulltime to part time?

Having trouble with the work regarding holidays and finding out what I am entitled to?

I have been there for nearly 2 years, and up until end of August I was full time(40hrs 5days) now started going to college so my hours are down to 14hrs over 3 days.

Our leave year starts in January to December although there is nothing in the contract about this but given the fact we were made to sign off 3 days at the start of the year for the Christmas week, on same contract for those days specified how many that would leave us with, which was 17.

Anyhow I have worked almost 9 months of this year as full time yet I only took 6 days off in that time, now since then been working part time but feel I am being mugged off about what they say I am entitled to saying 6 days at first then saying no it will be done part time etc.... I have phoned CAB and they don't know what the answer is. They were concerned about something whereby if you move from f/t to p/t you lose holiday entitlement built up whilst f/t, which is very concerning.

So any help would be much appreciated. So please help me!:o

    Do you have a annual leave card or sheet showing your holidays you have taken and booked?

    My point is, for every month you worked FT in the year, you accrued leave at the FT rate.

    If I was your employer, I personally would pay you for your accrued holidays and start you "fresh" with a new contract and leave entitlement.

  • I have taken 6 days when I went to Tenerife in May, and at the start of the year we were all made to sign away the three days leading up to Christmas.

    No offers of that regarding paying my entitlement, but that was why I need to find out as they were saying I am only entitled to part time holidays now even though I said no, as I had built them up whilst full time. So I think they may try and get out of giving me them.

    But no, no new contract was even discussed.

    OK, to keep it simple ...

    Suppose your company's leave entitlement is the stat min of 24 days including bank holidays.

    That means for every month you worked full-time you accrued 2 days leave.

    So that's 9 x 2 = 18, less the 6 you took for Tenerife, less BHs on New Year's Day, Good Friday and Easter Monday, 2 May Bank Holidays, and the August bank holiday. I make that 12 days, leaving 6 days.

    Now it gets slightly more complicated, because if you were working 40 hours over 5 days and you're now working 14 over 3 you're not working such long days. BUT if your days are (roughly) equal in length now (just under 5 hours per day) then you're entitled to 2 days per month x 3 months divided by 5 days per week multipled by 3 days per week. Which is (very roughly) 3.5 days.

    If you're actually working 2.5 days per week then change that last 3 to a 2.5.

    And here's where it gets even MORE complicated, because you shouldn't have to take both the bank holidays and all 3 of those closure days out of your holiday entitlement, you should only have to take 3/5, ie 3 days.

    either way, I think you have quite a lot of leave left to take in a short space of time, do check whether you can carry any over to next year (where I work it's a week's worth, to be taken before the end of March).
